Our hypothetical scammer can just say he was improving the mine so he could take potential business partners down there to show them the mine.
I am sure they would send an inspector before and after the work is done but you are ridiculously overplaying your hand by suggesting inspectors would know if they are improving the mine for their own use.
How can you tell whether they improve the mine for their own use vs if they improve the mine to try to find a partner to develop the claim?
Are they going to photograph every wall to prove no minable rock was removed? Before, during, and months or years after getting approval?
Our hypothetical scammer is not doing anything wrong by improving the mine!
Our hypothetical scammer can always say prospectors broke in if they discover there has been mining, but they may never notice because he's only after enough gold for himself and a few partners, and they know there's been work going on there, there's excavation fill on the property.
