Which documents are you referring to Chess? The June 13, 2011 Blackstone-Skadden service offer? The Fannie Mae February 29, 2012 press release? The FHFA Updates Projections of Potential Draws for Fannie Mae and Freddie Mac, (October 26, 2012)? Others?

In any case, the first was a confidential document. The other two are in the public domain and readily available.

The Blackstone-Skadden document partially suits the investment interests of the US Treasury while the discussion of restructuring GSEs along with possible privatization overreaches into FHFA's statutory administrative territory as conservator as well as venturing into areas that could result in directing Congressional legislative activity. At least it can be construed that way in a court of law.

The other two documents have been available and do not add to the cases since they should already be well aware of what is present in those documents.
