Order on Motion for Dismissal pursuant to docket for civil case #: 2:14-cv-03381-PA-VBK. ORDER granting in part and denying in part 19 Letter Motion for Extension of Time to Amend: As discussed with the parties at today's telephone conference, Defendant's request to file an amended complaint thirty days after the Court adjudicates any motions to dismiss in the Class Actions is GRANTED. His request to file an amended complaint fourteen days after the lead plaintiff in the Class Actions files the consolidated complaint is GRANTED. Upon further consideration, the initial pretrial conference, scheduled for August 8, 2014, is ADJOURNED. Because Plaintiff has represented that he intends to file an Amended Complaint, Defendant's presently-pending motion to dismiss is GRANTED as moot. Consistent with Rule 4(C) of this Court's Individual Rules and Practices in Civil Cases, after Plaintiff files an Amended Complaint, and have indicated that they wish to rely on appeals to fight the ruling of the dismissal.
