"Just finished reading the reply brief, to sum it up Google are trying to retry the case (this strategy will not work) but they also try to introduce new evidence (that will not be considered by CAFC) on New Adwords being colorable different without directly addressing Mr. Furrow's deposition - that is obviously damning and impossible for them to explain.
One main difference I see is how they structured their arguments promoting a constitutional argument to the top - trying to set this up for a SCOTUS hearing on a 7th amendment violation (which is just BS). This may be a sign that they know CAFC will not reverse."
