You are correct, the SEC isn't done but the Federal Courts are. They have issued their ruling for a conditional bar prohibiting Rooney from operating another fund and which allows him to remain as CEO of Positron.

All the SEC has left, which you linked to in an earlier post is to make a determination for a bar or suspension from association with investment advisers. [Associated person of an investment adviser means any person who for compensation refers, solicits, offers, or negotiates for the purchase or sale of investment advisory services.] Obviously, this does not concern Positron.

As far as lies go, one would have to prove that they just weren't delays beyond Positron's control. For example: SR-82 shortage, manufacturing problems at the Cardiogen-82 manufacturer Nordion, unauthorized expiration date extensions on the generators at clinics, the Cardiogen-82 recall, a slow and controlled reintroduction of the generators, another SR-82 shortage due to quality standards at Nordion, AND the NRC issuing guidance on August 23, 2013 concerning the Cardiogen-82 infusion cart and radiation detector stating "every NRC licensee using the Rb-82/Sr-82 generator would be in non-compliance with the regulations in 10 CFR 35.60 and 35.63 and would be cited for repeated violations for which there would be no acceptable corrective actions."

These delays have piled up and lasted 2 3/4 years, and were all directly related to Bracco. Unfortunately, Bracco is the only current supplier of RB-82 generators, which is the only use for SR-82. Your suggestion about simple complaints about lies would have an uphill battle, to say the least, considering that had one done their DD, they would realize that this is what an investment in POSC is all about.
