According to pacer, the judge yesterday ordered the motion to stay and also ordered the parties to provide a status every 6 months to the judge. The first date is 1/7/15 and then on 6/25/2015. Meanwhile,
H&W has until August 12 to respond to what eBay's attorneys filed on May 12th. Subsequently, the USPTO has 90 days to either grant or deny the request for a patent re-examination. That time frame puts us about November 12th. If the patent office re- examination is granted, the patent office has up to 12 months to complete the review. I have seen reviews that have taken several months to nine months to complete. Also, it is possible, the patent office will deny the request a re-examination. The bottom line to me is getting the patents upheld whether they are re-examined or not. I'm sure those of us who are long are banking on the patents being upheld one way or the other. If so, we win huge, IMHO. To me, it's just a matter of how long it takes and how much we get . Thanks.
