If Judge Sleet is waiting for the US Court of Federal Claims to assign ownership of the Anchor Litigation Award - which is what I am thinking - Judge Sleet could then grant WMILT's
" Motion to Dismiss " on the basis that the US Court of Federal Claims did not consider the LTW Holders to have an ownership interest in the Anchor Award.

The Anchor Litigation Award is not an Asset of the WMIH Bankruptcy Estate until assigned so by the US Court of Federal Claims and - as you point out - should not have been litigated in the Bankruptcy proceedings. I expect Judge Sleet knows this and thus the reluctance to render a Decision.
