APT vs MonsterMoto lawsuit

Among APT's complaints are this:

107. Monster Moto has interfered with MotoVox’s business expectancies with these
customers without justification, by telling them that MotoVox was having financial difficulties, was going out of business and/or was about to declare bankruptcy. At a minimum, MotoVox is informed and believes and on that basis alleges that Monster Moto told Sears that MotoVox was going bankrupt and that customers were leaving... http://www.scribd.com/doc/231937060/APT-Group-v-Monster-Moto-Amended-Complaint#fullscreen

IMO APT's overdue audited financials will prove whether this was true at the time or not. A court could take a look at those and make the case that APT was --for all intents and purposes-- "bankrupt" in early 2013 when their ex-employees and consultants jumped ship.

IMO the audited fins will be a horror show.
