You guys can say what you want, but I think his committment to not appeal if the SA is approved, is a major concession on his part, and I thank him for that.
I, too, wish that he would write a letter to either the Judge or the attorneys, or both, in which he states that if a definate, and enforceable date for the finalization of the share distribution is inserted in the SA, then he would withdraw his objection to it's approval. He has not yet agreed to that at least not yet, but I believe he would not continue to object if it were done. I have asked the attorneys to undertake such an action. Art
