Contingency does not mean they have to receive money for the attorney to be paid. It could be something like: If you get our credit vs. Bodie down to less than $2,000 we will pay you $1,000 or any variation similar to that. I am in no way saying that your reading of the complaint, and or application of it in a court, is correct. My point simply is that the assertion that they will be broke due to litigation expenses is not based on the actual knowledge of the agreement between MRIB and their attorney.
