You've never heard of a lawsuit being filed and then dismissed? It happens frequently. However, if the larger company doesn't rescind, you've still made a name for yourself at that point. Whether you move forward with the lawsuit immediately, whether you file with the court for a continuance that would postpone the lawsuit (we all know in cases like this that could delay the hearing for a year or two, or whether you opt to withdraw the lawsuit altogether (which doesn't implicate the company in any way, and you can re-submit a claim at any time later on). Whether you do any of these, you have gotten your name out there with the big dogs. And that was my point to the post you replied to. You can still use your money to build the company without spending any of it in court. You can file a lawsuit and file a continuance for free with the intention of not going to court.
I'm no attorney, and I'm not suggesting this is the way to do this. Just merely throwing it out there as a discussion topic as well as suggesting that sometimes thinking outside of the box as far as how you can benefit from an "attempted court hearing" might be more valuable than you think and not really cost anything. Free positive publicity. I'm sure there are some negative aspects as well. But the underdog (us) is ALWAYS the most rooted for in the fight. ;)
