No, dilution isn't a crime, it happens on every board. They look for those that make blatant false claims.
They haven't, they have a machine, it's in a despencery, the want to ship a 1,000-1,500 as a goal. No fraud!
I saw PHO* PDFs waring them from back in Dec asking them to clarify statements or retract them. They sent 5 until they had enough and halted them. I guess a good question would be to ask Stephen if he had received any such communication from them, if he's honest (and feel he is) he can answer truthfully.
