If the FHFA is found not to be US/US Government/arm of the US Treasury, than there is no takings case against the FHFA possible in the US Court of the Federal Claims. The Fairholme suit can then be dismissed. Knowing this, Fairholme also filed and injunctive relief suit in the US District Court for the District of Columbia. So far, the US Government has not been able to have the case dismissed and that motion is stayed until discovery is completed.

Do you mean indicted? if you mean indicted, the US DOJ Attorney General would have to bring a criminal case against individuals for a federal crime. The cases are already civil cases.
