I think you're exactly right. And what made it worse was that he was using the stock to fund operations, so his lying became a vicious cycle. He dug his hole deeper and deeper.

And that is why the SEC is going to hammer him: they can prove he had a clear incentive to mislead shareholders.

What a farce of a CEO he was.
