No. I've explained what happened here a million times. TDA wasn't deliberately shorting BCIT. Yes, ALL the brokerages would have been smart to refund BCIT shareholders' money in the fall of 2005, but hindsight is 20/20, and I imagine at that time their legal counsel thought it had reason to advise against it.
