I would think that FHFA acting as an independent regulator would be acting as the gov't. Only in certain aspects is FHFA acting as conservator, where, like FDIC, FHFA has some protections from court oversight. I would think that the regulatory role is broader and deeper in some sense then the conservatorship role, which is narrower and more targeted.
