Yes. Judge Sweeney has several options under the Federal Rules of Civil Procedure (i.e. Rule 26) and the Rules of the US Court of Federal Claims (e.g. Rule 26). The Plaintiff and non-parties also have options.

There are different options for determining the confidentiality status of documents in discovery. For example, If there is confidentiality ordered for a document or documents, that neither the Plaintiff or court object to, a non-party with standing can seek access and get it if there are qualifications. For example, the press can apply for access to confidential documents based on presumptive first amendment rights.
