Since the license was terminated, Scanbuy has both infringed NeoMedia’s patents and engaged in a series of attacks on NeoMedia.
I also don't see how a cash settlement helps NeoMedia in the long run. I have posted before that the Scanbuy breach could be more profitable than the Scanbuy license.
