I think you have it backwards with the trademark thing . Anybody can call themselves BudGenius, unless the trademark is registered in which case only the registrant may do so.There is absolutely no prohibition against BudGenius using their expired trademark, they just can't prevent anyone else from doing so, however even those parties using their namesake cannot represent themselves as being the same" bud genius
