No. NITE buys and sells shares for Scottrade and other online brokerages. The only thing it means is that someone like you or I is sitting on the bid waiting for shares and someone else is sitting on the ask waiting to sell. 99% of the time if I put in a buy or sell order on Scottrade, my order shows up on L2 under NITE. That said, it is possible that someone using an online brokerage that buys and sells shares through NITE is shorting. But NITE being on both bid and ask in and of itself is not an indicator of a stock being shorted IMO
