After listening to the recording of the oral argument, I personally believe that the much stronger, clearer, presentation was made by Vrng’s legal counsel. Google’s counsel’s argument was quite disjointed, and so filled with “uhs” and “ums” as to be almost embarrassing. I especially thought that the court’s late query/point made to Google’s counsel to the effect that both the patent re-exam and the jury had been presented with the “obviousness” question raised by Google---and specifically ruled in Vrng’s favor --- was telling.
