I love the expression "I am neither an optimist or a pessimist, but I am a realist." Logic would dictate that WDDD gave up on any payoff for the pre-certificate infringement. So realistically, they could now go for the infringement from the certificate forward. ACTI was offered a license and they refused which means they deliberately infringed on the patent and is libel for treble damages in a court of law. Therefore, I surmise that negotiations are going on for a settlement and Susman Godfrey would not settle for anything less than the expected royalties plus their legal fees and a little more, but less than treble. ACTI of course wants to get off as cheaply as possible. Where is the numbers guru, I am thinking $4 a share and then all the lawsuits after. JMHO
