So many people are pinning their hopes on a SJ. What if the judge prefers to duck that and sends the whole mess to trial so the jury can take the rap? What will your view be then? SJ are not just legal constructs they have significant political implications, especially considering that Congress is considering how to prevent patent trolling and curbs for the "sympathetic judiciary" that fosters it. Also, there was data presented here on the good Judge Larry six months or so ago -- he never has issued a SJ in patent infringement cases in his entire career. It will take some digging to find the citation from the Federal Court system, but it is there.
