None of that is fact in the Supplemental Motion....

like a cruise ship from the Bahamas to Greece....LOL ....no one in the industry would consider such a foolish transatlantic itinerary.

There is so much non factual in those Supplemental Motion, but this forum is not the place to correct/identify perjury.

I suspect four possible outcomes tomorrow.

1)Sustain the Summary Judgment as is, due to too many procedural failings of the Defendant.

2)Uphold the Motion to Vacate, and order a Trial but with Peter posting a Bond.

3) Uphold the Motion to Vacate, and Trial set.

4) A postponement of the Hearing. There has not been any postponement requested by the Plaintiff in the past however. I believe the Defendant had requested a postponment before however.

I believe the Summary Judgment will stand as is based on the material evidence that has been presented to the court and not refuted. The Promissory Note, The Receipt of Funds, the Non-Payment and Default of the Promissory Note. Everything else is unproven noise.
