As Nc73 pointed out, the answer is no. Patent law these days is a joke as patents are no longer granted in perpetuity. Basically by the time a patent holder collects all the evidence for a suit, files it and then it goes through all the legal back and forth...the patents are generally almost expired by the time any legal decision happens. And unless you are Apple, the cost of going after someone for patent infringement is higher than the reward (if you can ever even get them to pay).

This is the reason why ERBB has stated they aren't going to bother with getting any patents on the machine, as it is just a huge waste of time and money.
