This law suit is about DFI transferred the property to DFMI and later was seized by Dimension through foreclosed of DFMI.

If Dimension can proved that DFI and DFMI was legally merged, then , the defendant wins. The proof is not anything Dimension "says" that DFI and DFMI was merged, or what DFMI or Dimension has done, such as the year 2000 tax or the 29 original investors gave up their DFI shares and got certificates from DFMI, because all these can not proved directly that DFI and DFMI was really merged legally, so the evidence should be legal document, which clearly stated that DFI and DFMI was officially and legally merged , signed, and recorded. Other than that , nothing can prove that DFI and DFMI was really and legally merged, and Dimension lost.

You can not claimed that two companies have been merged while you can not provide any legal documentation to prove it , just like you can not claim that your neighbor's property is yours while you can not provide any legal documentation to prove it, otherwise, why do we need the law, the legal contracts ? and anyone can just claim whatever he wants to belong to him without any legal proof
