Yes, But not everyone has such a strong case that Summary Judgment is awarded because the evidence is so strong that the Judge determined a trial is a waste of time.

Let's review the Texas Case:

Promissory note signed.
Monies delivered.
Defendant, Peter V, fly across the country to Texas to sign the note after receiving the funds.
Witnesses for the Plaintiff are readily available.
Peter V refuses to make the payments as agreed.

Hard evidence of delivery of funds.
Hard evidence of terms of loan by the Promissory Note.

That is why a Summary Judgment was granted. These are the hard cold FACTS.
