You have to ask the question another way around.

DATA General filed for their patent some years before MYEC in 2008.

Why did MYEC never try to go after Data Generals Patent if MYEC thinks that theirs has a stronger backing?

DG has had not reason up to know to go after MYEC. Why should they: You infringe only if and when a Company signs a deal which means big Money, then you go after, certainly not before.
