If the MM's want to get around it, they would have to move the DLL-off chip.

That's where we disagree. They'd just have to have a non-infringing DLL on the chip. Whyte's construction does not cover all all DLLs on a chip, so there is plenty of room to maneuver here, IF they needed to. I am 99% positive they are already working on a design around based on his order. This is SOP in the business.
