The CTs are not in the BK, Ana. There is contract law (the prospectuses) and Federal Law (Dodd-Frank) that precipitated a filing by one of the board members - outside of the BK - to rule on our status. The two magic words were fiduciary responsibility.
I mentioned before that Judgy Wudgy throwing this back to cankles Chapman was to save face on her part. But if Judgy Wudgy was to rule, it would be in our favor due to the irresponsibility of the Trustee, per each prospectus. In other words - the full monty plus.

A funny thing happened a while back - oh, 47 years ago today. Three human beings travelled to another world, two landed, did a walkabout and all came back safely. Maybe the courage and fortitude is slowly creeping back. But that big gotdamn firecracker that started them Boyos was made just north of here - Huntsville, Sweet Home Alabama.

I mentioned before that this play, as with WAMU, is political. I know Judgy Wudgy would rule in a heartbeat for us. He means what he says. Cankles Chapman, however, is where this political angle is coming from. Don't like it, but it is interesting to view as we all want a decision either way. We are still good.

Unfortunately, Argus, it's what I surmised. And anyone can deduce what I did. You have two different courts - Judgy Wudgy and his no bullshite way of ruling and then you have cankles Chapman who is touchy feely. Not a good way to be as a judge.
And don't forget the details - both Pappy and WAMU declared BK with assets greater than liabilities. Pappy - over 600B and close to that with liabilities and WAMU with 32B a v 8 l. Plus, an over 300B mortgage portfolio waiting in FDIC to be delivered to shareholders - me. Yer gotdamnright it's political.
With all that said, I still believe in the rule of law and doing the right thing. Those that do not are cursed forever. Both of these plays will reward those who had the foresight and fortitude of laying down hard earned money to be here.
At the end of the day, drink beer, listen to Rush and throw a few T-bones on the barbie - with a Sinatra chaser of course.

That being said, a move to the grey sheets is a perfect storm for Pappy. Research why companies move their stocks on a trading market to the greys - mainly to protect themselves and, more importantly, their shareholders. But you be the judge.
