While all the hubbub goings on with the 13D battle, proxy vote screwups, Amarex meltdowns, etc were happening, I was researching CytoDyn's past a bit more. Very fascinating and entertaining at the same time.
Did anyone know that CytoDyn used to have its offices in Florida at 110 Crenshaw Lake Road, Lutz, Florida 33548 sometime around the 2010 timeframe? This was around the time Kenneth J. Van Ness was Chairman of the Board of Directors, President and Chief Executive Officer. CytoDyn still had its headquarters in Santa Fe, NM. There have been several people who have commented that they personally knew Van Ness and had business dealings with him and/or had introduced colleagues to Van Ness who went on to engage in joint ventures with Van Ness - especially in the real estate sector since Van Ness did a lot of consulting to real estate investors with complex financial challenges.
But...did you know...that CytoDyn during that timeframe bought Advanced Influenza Technologies Inc (AIT) in a stock transaction? AIT held the license for a DNA-based Influenza vaccine candidate developed at the University of Massachusetts Medical School in Worcester, Mass.

I found it very interesting that CytoDyn tried to get into the flu vaccine business. I guess an early attempt at trying to get a toehold by purchasing an asset in an attempt at "getting into the game"....a lot like what NP did when he purchased PRO140 from Progenics.
So, I guess this company, named UTEK Corp, is the one who sold their controlling shares to CytoDyn in this transaction. Why the heck would UTEK Corp be involved in vaccines, they were a Florida-based technology transfer company based out of Tampa who has gone through multiple personnel turnovers coupled with multiple run-ins with the SEC....recurring theme it seems....

From the FDA FOIA records the request was denied in this FDA FOIA Log on their public website posted for Feb 2021.

Not sure the impact that request had on the FDA or other organizations...but rest assured there were multiple other requests made to both the SEC and FDA before and after this one. All but one has been denied. The one still outstanding is under FDA Control #2021-3588 and it seems to be making progress according to the person claiming to have filed it.

The number of short shares went down - from 35,596,362 to 35,355,555. Ever so small downtick with two fewer contracts....
They're still at the ceiling on shares to short - 100%...But that can change either way at any time now.
Average short contract is now 96.14 from 92.93 days. Longer term contracts are continuing to hold out and those short borrowing costs are going up.
On the Ortex site, borrowing cost doubled from last week. Monday (27Sep21) was 10.98 and Monday (4Oct21) was 25.27.

Short lending volume went from 695,528 to 433,981 - still a lot lower than I was expecting. The shorts are still waiting in the shadows.

Still looks like their next pain threshold is in the $2.70 to $2.75 price range. Maybe as low as $2.65.

A few things changed from yesterday.
The number of short contracts went up again. From 286 to 294.
The number of short shares went down - from 37,144,468 to 35,585,942.
They're still at the ceiling on shares to short...But that can change either way at any time now.
Average short contract is now 92.21 from 89.46. Longer term contracts are continuing to hold out and those short borrowing costs are going up.
The jump up by over 2.5 days in one day makes one wonder where these older contracts are coming from....
Short lending volume went from 139,232 to 1,738,926 - a bit of a jump in volume and it was reflected in yesterday's price.
Remember, the shorts only make money if the stock price drops.
Cost to borrow went from 14.25 to 16.83 - slow crawl upward.
There was a report from FINRA yesterday that showed a cost to borrow of 49.12% yesterday. Not sure why the difference of rate here vs FINRA.
Another increase of 8 short contracts in one day and a drop in number of shares shorted. Looks like they're coming out of the woodwork....can somebody turn on the lights and get a can of Raid?

The business entity "Global Discovery Group Inc." has several different "media outlets" they use with different names - it's called "branding".
"Branding" does not necessarily have to have a registered business registration.
Take for instance the site "EMERGINGGROWTH.COM" (see below) and I've even included the SSL certificate chain to assure everyone that this isn't doctored up.
Notice right there on the web page - in BIG letters so everyone sees it - "Global Discovery Group" (GDG). Because GDG uses the "EmergingGrowth.com" name as "branding"....not as a subsidiary.
They're 100% out in the open of which company you're dealing with on the website.
And because "branding" is important to a business, they even secured the domain "EMERGINGGROWTH.INFO". You won't find a "GlobalDiscoveryGroup.com" because somebody else snatched that on GoDaddy as part of domain squatting and Tambuerello probably doesn't want to give the aholes that are squatting on the domain a dime for him to register it in his name.
So...back to "EMERGINGGROWTH.INFO".... again...right on every web page of the site you'll see the "Global Discovery Group" branding.....with a "Info@EmergingGrowth.com" email address right above the "Powered by Global Discovery Group, Inc" footer.
Now, Tambuerello is a pretty active and enterprising businessman. Check out all the Florida Division of Corporations registrations for his business entities. He probably found that he didn't need to spend all the money renewing certain domain names if he was up front about business associations. And, if he *IS* supposed to renew them....then "someone" needs to get on the horn and complain to the Florida Division of Corporations so they can send the SWAT team out and gets a check for those that are now delinquent....a la "Elian Gonzalez" style.

Could be a Regus tenant. I worked for a 12 employee company that grossed $15M/year providing consulting services - no product - that used a very similar arrangement. Once we quickly got through the bumps of that type of arrangement, our net went way up because we didn't have the millstone of fixed space leasing costs, insurance, utilities, etc that go with a fixed presence. Definitely the smart way to go nowadays with technology based businesses - virtual is where it's at baby.
