Wal-Mart China CEO quits as retailer grapples with pork scandal

SHANGHAI/HONG KONG (Reuters) - The head of Wal-Mart Stores Inc's China business has resigned citing personal reasons, after the world's largest retailer ran into trouble with Chinese authorities leading to store closures and employee detentions.
The departure of China CEO Ed Chan, along with Senior Vice President of Human Resources Clara Wong, is another setback for Wal-Mart which is facing stiff competition from local firms in the strategically important market.
The company, which recently celebrated its 15th anniversary in China, closed more than a dozen stores in central China last week following allegations they sold regular pork as organic pork over the past two years.
Authorities in Chongqing have arrested two Walmart China employees and detained 37 others over the incident.
Both resignations announced on Monday were for personal reasons and had "no correlation" with the investigations in Chongqing, Walmart Asia spokesman Anthony Rose said.
"We have used the last few days to put in place corrective actions in our stores," Rose said, adding that the stores would reopen by October 25.
This is the second round of top-management resignations at Walmart China in less than five months. In May, its chief financial officer and chief operating officer resigned "to explore other opportunities," the company had said.
"It's really hard to say whether this (Monday's resignations) is a consequence of that (pork scandal)," said Torsten Stocker, a China retail analyst with Monitor Group.
"It might be, but I think at the end of the day, it is still not clear what really happened in Chongqing," he said.
"Obviously what happened in Chongqing is impacting their business in Chongqing and presumably ought to be having some impact on the grand overall business. Any type of leadership change like this, it's never a good thing."
STRUGGLE IN CHINA
After entering China in 1996, Wal-Mart's expansion gathered steam in 2007 when it bought a 35 percent stake in Taiwanese hypermarket chain Trust-Mart. It has 353 stores in the mainland.
Wal-Mart's market share in hypermarkets was 11.2 percent in 2010, in second place after China's Sun Art <6808.HK>, but spending for the expansion has weighed on its profitability.
Wal-Mart's problem is that it is trying to compete with domestic chains on price, said Shaun Rein, managing director at Shanghai-based China Market Research Group.
"If your strategy is 'cheaper than Chinese companies', you are never going to win the market," Rein said.
"But that is what Wal-Mart is trying to do. The strategy is all wrong since the very beginning, and that is why it has never been profitable here."
Wal-Mart competes with French hypermarket chain Carrefour , Britain's Tesco , Germany's Metro AG , China's Sun Art and China Resources Enterprise <0291.HK>.
China's hypermarket sector is forecast to grow at a compounded annual rate of 10.1 percent between 2010 and 2015, according to Euromonitor. But price competition is particularly tough in that segment.
Walmart Asia CEO Scott Price, who will also serve as interim China head, said China was a strong market for the group.
"China is a very important market for Wal-Mart and China's 12th five-year plan will provide strong opportunities to the retail industry," Scott said in a statement on Monday.
FIRMS UNDER SCRUTINY
Major Western firms are under scrutiny from China's state media and face criticism over issues including food safety and garment quality. Some executives complain privately that their companies are subject to stricter enforcement than local firms.
This summer, oil company ConocoPhillips was roundly criticized by Chinese media over a June oil spill off China's east coast. The State Oceanic Administration has threatened to sue ConocoPhillips, but not its state-owned partner, CNOOC <0883.HK>.
Last week, European luxury group Gucci said it had replaced two managers in southern China after former workers at a store released an open letter alleging employee abuse.
"Walmart's problems are similar to other rivals, particularly the foreign operators, including competition for staff," said Alex Wong, a director at Ample Finance Group.
"A relatively high (staff) turnover rate suggested that it has some problem with its incentive plan in recruiting and retaining sales people," Wong said.

Which Animals Does the Bible Designate as 'Clean' and 'Unclean'?
God reveals which animals—including fish and birds—are suitable and unsuitable for human consumption in Leviticus 11 and Deuteronomy 14.
Although the lists aren't exhaustive, He reveals guidelines for recognizing animals that are acceptable for food.
God states that cud-chewing animals with split hooves can be eaten (Leviticus:11:3; Deuteronomy:14:6). These specifically include the cattle, sheep, goat, deer and gazelle families (Deuteronomy:14:4-5). He also lists such animals as camels, rabbits and pigs as being unclean, or unfit to eat (Leviticus:11:4-8). He later lists such "creeping things" as moles, mice and lizards as unfit to eat (verses 29-31), as well as four-footed animals with paws (cats, dogs, bears, lions, tigers, etc.) as unclean (verse 27).
He tells us that salt and freshwater fish with fins and scales may be eaten (verses 9-12), but water creatures without those characteristics (catfish, lobsters, crabs, shrimp, mussels, clams, oysters, squid, octopi, etc.) should not be eaten.
God also lists birds and other flying creatures that are unclean for consumption (verses 13-19). He identifies carrion eaters and birds of prey as unclean, plus ostriches, storks, herons and bats.
Birds such as chickens, turkeys and pheasants are not on the unclean list and therefore can be eaten. Insects, with the exception of locusts, crickets and grasshoppers, are listed as unclean (verses 20-23).
Why does God identify some animals as suitable for human consumption and others as unsuitable? God didn't give laws to arbitrarily assert control over people. He gave His laws (including those of which meats are clean or unclean) "that it might be well" with those who seek to obey Him (Deuteronomy:5:29).
Although God did not reveal the specific reasons some animals may be eaten and others must be avoided, we can make generalized conclusions based on the animals included in the two categories.
In listing the animals that should not be eaten, God forbids the consumption of scavengers and carrion eaters, which devour other animals for their food.
Animals such as pigs, bears, vultures and raptors can eat (and thrive) on decaying flesh. Predatory animals such as wolves, lions, leopards and cheetahs most often prey on the weakest (and at times the diseased) in animal herds.
When it comes to sea creatures, bottom dwellers such as lobsters and crabs scavenge for dead animals on the sea floor. Shellfish such as oysters, clams and mussels similarly consume decaying organic matter that sinks to the sea floor, including sewage.
A common denominator of many of the animals God designates as unclean is that they routinely eat flesh that would sicken or kill human beings. When we eat such animals we partake of a food chain that includes things harmful to people.
As nutritionist David Meinz observes: "Could it be that God, in His wisdom, created certain creatures whose sole purpose is to clean up after the others? Their entire 'calling' may be to act exclusively as the sanitation workers of our ecology. God may simply be telling us that it's better for us believers not to consume the meat of these trash collectors" (Eating by the Book,1999, p. 225).
The following list, based on Leviticus 11 and Deuteronomy 14, identifies many of the animals God designates as clean and unclean. The list uses their common names.

Speculation. You weren't there on this development, or were you? Every case is an individual case. You can gather information on previous cases, and if lawyers think it is applicable, use that past evidence as a point in reference in a trial, but until then, it will still have to be proven that the information is applicable by a jury, or judge, or both.
Until then, it is speculation.
Individuals ultimately make their own decisions. Whether anyone opts out of any health care treatment for another is ultimately their decision. You weigh in the information, and you make your decision. I don't see any thing here that there was any coercion involved in having an individual opt out from traditional FDA approved drugs for AQLV's water treatment.

Environmental Infrastructure Holdings Corp (OTCBB: EIHC), today announced that its Board of Directors and executive officers have renewed and extended their original three month lock-up agreement as of September 19th, 2011 which will effectively lock up a total of 36 million shares of the Company's stock owned by them collectively or 38% of the Company's 94 million total shares outstanding until December 1, 2011 with the option to extend the period. The Agreement provides that each Director and Officer will not directly or indirectly trade or sell or otherwise transact their portion of the 36 million common shares of the Company for the stated period. The one exception being that management can sell a limit of $1000 per day in Company shares with a target price no less than the previous days' close up to 700,000 common stock shares for accumulated deferred compensation.
"The purpose of the lock up agreement is to foster long term interest in our stock among our existing and new shareholders and investors. Management and our Board are continue to be strongly committed to our acquisition model and long term growth," said Michael Parrish, Company Chairman.
Basically, they're saying, "Hey guys, we're locking up our shares for a bit here, but we can sell up to $1000 per day, and if you hold on to it a bit more, we can dump the rest when it comes due in December." A tune of 36 million if they want.
Nice way to foster long term interest in our stock to new and existing stockholders, eh? You hold, or buy our stock while we dump.
