Three cannabis reform bills reintroduced in Congress

The list of pro-marijuana reform bills in Congress just got a little longer.
Not only was the anticipated bipartisan SAFE Banking Act reintroduced on Thursday after a much-publicized congressional hearing last month, but two more members of the House of Representatives held a news conference on Capitol Hill to call for federal reforms.
Flanked by several cannabis advocates, U.S. Reps. Tulsi Gabbard, a Hawaii Democrat, and Don Young, an Alaska Republican, announced they’re reintroducing two measures that would advance the marijuana industry:
The Ending Federal Marijuana Prohibition Act would remove MJ from the list of federally controlled substances.
The Marijuana Data Collection Act would study the impacts of cannabis legalization across the nation.
The measures were first introduced in 2018 with 39 co-sponsors and 34 co-sponsors, respectively.
“We must end the federal prohibition on marijuana now,” Gabbard said at a news conference. “This is … the only bipartisan legislation that deschedules marijuana.”
After that news conference, the office of Colorado Democratic U.S. Rep. Ed Perlmutter announced the reintroduction of the Secure And Fair Enforcement (SAFE) Banking Act.
The measure, which would prevent federal regulators from punishing banks and other financial institutions that provide services to MJ companies, was introduced with 106 co-sponsors, according to Perlmutter’s office.
The SAFE Banking Act is also sponsored by Washington state Democrat Denny Heck and Ohio Republican Reps. Warren Davidson and Steve Stivers.
A multitude of reform bills already have been introduced on Capitol Hill by both Democrats and Republicans, including the Marijuana Justice Act, which would remove MJ from the Controlled Substances Act.
But Gabbard and Young’s descheduling bill is the most liberal of all, since removing marijuana from the list of federally controlled substances would be tantamount to federal legalization.
Young said marijuana industry stakeholders in Alaska have told him repeatedly that not having access to banking services has been their “biggest challenge.”
“This bill takes care of that,” Young said Thursday.
Other members of Congress have thrown their weight behind the States Act, a Senate bill that not only promises to solve the banking crisis but would protect state cannabis laws from federal interference and simultaneously address the 280E tax conundrum.

San Francisco has become the latest city to push for old marijuana-related criminal offenses to be cleared, with the city's district attorney announcing that thousands of people will have their cases dismissed and sealed.
In all, 9,362 people will be eligible for dismissal, according to George Gascon, the San Francisco District Attorney. Each of them had received either a misdemeanor possession convictions or felony convictions for possession with intent to sell, sales or transportation of marijuana or the cultivation of more than six marijuana plants.
Gascon and his team worked with Code for America, a non-partisan group focused on improving government services through technology, to identify the cases — an effort that had been ongoing since January 2018.
"It's important because when people have criminal convictions — especially felony convictions — they are precluded from participating in society in many ways," Gascon said, adding that "we as a society" have determined that the so-called "war on drugs" has been ineffective and this is one way to fix it.
"It's time to unwind the damage that we did," he said.
The move comes as cities and states across the nation work to dismiss similar cases related to marijuana convictions.
In January, Denver announced its "Turn Over a New Leaf" program. So far, it hasn't required applicants to pay for any part of the dismissal or sealing process, according to the Denver District Attorney's Office communications director Carolyn Tyler. She said that courts will waive certain fees while a marijuana advocacy group pays the fee for approved applicants to have their records sealed. It's unclear how long this funding will last, though.
As of Feb. 27, only 38 people have qualified for the program since the measure only applies to individuals whose arrests took place in Denver.
Unlike Denver, San Francisco's initiative will not require inmates to apply. Instead, inmates will automatically have qualifying records dismissed and sealed, with the option to opt out if they want.
In Maine, state legislators are working on a measure to seal or expunge past marijuana convictions throughout the state, the Portland Press Herald reported in January.
In September 2018, judges in Seattle dismissed over 500 marijuana possession convictions, and Gov. Jay Inslee announced a plan to pardon people with misdemeanor marijuana convictions, which could apply to thousands more.
"We shouldn’t be punishing people for something that is no longer illegal in Washington State," Inslee said at the time of the announcement. "Forgiving these convictions can help lessen their impact and allow people to move on with their lives. It’s a small step, but one that moves us in the direction of correcting these injustices."
Although changes to marijuana policies are happening at a faster rate in the 10 states where recreational use has been legalized, other states are also making efforts to ease their laws. In New York City, for example, possession of or smoking marijuana in one's own home has been decriminalized.
Manhattan District Attorney Cy Vance spoke to a city council committee on Wednesday, noting how there was a 98 percent drop in marijuana prosecutions between Jan. 1 and Feb 26 this year compared to the same time period last year.
"The dual mission of the Manhattan District Attorney’s Office is a safer New York and a more equal justice system. The prosecution of predominantly black and brown New Yorkers for smoking marijuana serves neither goal," Vance said at the hearing.
Although marijuana is still illegal on the federal level, Sen. Cory Booker (D-New Jersey) and two other Democrats reintroduced a bill on Thursday that would legalize marijuana on the national level and clear related convictions.

In recent years, 10 states and Washington, D.C., have passed laws legalizing marijuana use for adults over the age of 21. A total of 33 states have passed laws legalizing the drug for medical use. But marijuana is still considered a Schedule 1 drug by the Drug Enforcement Agency, setting up an enforcement conflict between federal and state law enforcement agencies.
Two members of Congress from California, Rep. Ro Khanna and Rep. Barbara Lee, introduced the House version of the Marijuana Justice Act.
President Trump offered his support in February to a separate bill introduced by Warren and Sen. Cory Gardner, R-Colo., which seeks to block the federal government from enforcing federal drug charges in states that have legalized the drug.
An October poll by the Pew Research Center found that 62 percent of Americans now believe that marijuana should be legalized. An overwhelming 74 percent of millennial voters support doing so.

Bill reintroduced in US Senate to remove cannabis from Controlled Substances Act

New Jersey Democratic Sen. Cory Booker reintroduced legislation that would remove marijuana from the Controlled Substances Act, effectively meaning state-legal cannabis businesses would not have to fear federal interference and could gain normal access to banking services.
The Marijuana Justice Act, first introduced by Booker and Rep. Barbara Lee, a California Democrat, in 2017, is being supported by presidential candidates including Kirsten Gillibrand of New York, Kamala Harris of California, Bernie Sanders of Vermont and Elizabeth Warren of Massachusetts. All are Democrats except for Sanders, who is an Independent.
But it remains to be seen how the measure will fare this year.
Industry officials are bullish about the prospects of federal reform, but experts say any reform package likely would need Sen. Majority Leader Mitch McConnell’s support.
“Senator McConnell is a key gatekeeper for Senate votes and passage, and I have no reason to think he wants to see any significant reforms enacted in the coming year, especially after he got hemp reforms passed late last year,” Douglas Berman, director of Ohio State University’s Drug Enforcement and Policy Center, told Marijuana Business Daily.
A number of marijuana bills are being reintroduced in the House and the Senate that would call for comprehensive reforms or that would resolve specific issues such as access to banking and fair taxation.
The Cannabis Trade Federation has beefed up its lobbying efforts to try to get the so-called States Act passed. That measure would allow states to determine their own cannabis policies with full federal protections.

Former Florida GOP congressman joins Cannabis Trade Federation as adviser

The Cannabis Trade Federation (CTF) is continuing to expand its policy and lobbying team in Washington DC, and the newest player to join the roster is former Florida congressman Carlos Curbelo.
CTF, which is pushing for federal marijuana reform, said in a news release Thursday that Curbelo, a Republican, was hired as a strategic adviser.
Curbelo, a conservative who championed the fight against IRS Tax Code 280E in Congress on behalf of the marijuana industry, was unseated last year in the midterm elections. He also signed on to other cannabis reform bills, such as the States Act, which is a CTF priority this year.
“This is a states’ rights issue,” Curbelo said in the news release, referring to the legalization and regulation of marijuana.
Curbelo added he’s joining CTF’s team “because I know that they are the most effective cannabis industry lobby.”
Neal Levine, the CEO of the Cannabis Trade Association, said in the release that Curbelo was “a commanding advocate for cannabis reform while he was in Congress.”
Since the beginning of 2019, CTF has hired 15 lobbyists and brought on longtime legalization movement insider Steve Fox as part of its plan to push federal MJ reform.
The Cannabis Trade Federation was formed in April 2018.

So you want to open a cannabis business. That's great – now is a perfect time to test the waters, with public opinion at your back and the Green Rush on the horizon.
But this isn’t like opening up a coffee shop or corner store. There are a number of elements that you’ll need to consider that are unique to the cannabis industry – everything from compliance in a heavily-regulated marketplace to security concerns to how to handle a transaction when a customer looks to make a purchase.

To understand different types of cannabis businesses, a good place to start is by looking at Terra Tech Corp., a company that cultivates and sells cannabis. As a vertically-integrated company, they are able to manufacture and sell a variety of their own cannabis products, including flower, concentrates, edibles, and topicals, under their own IVXX brand.
Even though IVXX sells its products at wholesale to hundreds of dispensaries, Terra Tech also operates multiple dispensary locations (operating under the retail brand Blum) across California and Nevada.
As a publicly-traded company with operations in several links of the cannabis business chain, Terra Tech. has had to scale their growth smartly and keep their big picture goal in mind with every decision that they make.
Terra Tech represents one extreme of the cannabis business spectrum, but with the industry still in a nascent phase, there are many other types of businesses available to cannabis entrepreneurs.
Before a cannabis company – whether it’s a retailer, cultivator, processor, or some combination of the three – gets off the ground, the company first needs to choose its business model and clarify the company’s goals. When considering retailers or dispensaries, there are four main types of business models that you might undertake.
Boutique Stores
While Terra Tech had big ambitions from the start, other companies are started at a much smaller scale by entrepreneurial cannabis connoisseurs who are passionate about the plant and the industry. With state-level legalization spreading, they see an opportunity to serve their community while generating enough cash flow to make cannabis their full-time job.
Like any business built on an owner’s personal passions, these boutique stores focus on the customer experience and concentrate on the quality of the sales experience over the quantity of shoppers and sales. The point of a boutique is to purposefully slow down business while boosting customer experience, order size, and profit margins.
In a boutique store, your budtender may let you examine flower under a magnifying glass to get a good look at the trichomes, or may let you smell the product, or may spend time with you going through a product’s terpenes and their various effects. They’ll often choose and weigh your purchase in front of you.
These businesses are also set up to encourage customers to spend extended amounts of time in the store, which translates into less volume as more time and energy is spent on each customer, so revenue is dependent on selling more per person.
Transactional Stores
In contrast to the boutique store, transactional stores drive towards volume and speed. Think Wal-Mart, for example. The goal is to get the store packed, keep the store packed, and move through customers quickly so the number of transactions rises.
Where boutique stores are all about the experience and the personalized customer service, transactional stores are about convenience, speed, and efficiency.
In a transactional store, products are all pre-packaged and ready to be pulled off the shelf, because an owner’s priority is to increase the number of transactions. One other contrast to boutique stores is that transactional stores also often have more opportunities to grow. Because the main driver is volume, these stores generate more revenue and tend to operate in areas with higher populations.
Multi-Store Operations
Multi-store operations are revenue-driven models of expansion. Typically, an owner builds a successful boutique or transactional store, then uses that store as a blueprint to replicate it in new locations.
With a single store, your revenue is limited by how many people can fit inside. With multiple stores, however, there is an opportunity to make more money. Owners invest in the business to grow top-line revenue so they can drive a generating cash flow and then keep buying new stores.
Franchising
Finally, there is the franchise model. Like franchises in other industries, this model is marked by an owner providing their successful formula to a third party, who then uses it to open their own store.
Franchisees pay the owners for their operating procedures and business formula, and to provide product. They also pay owners to advertise on their behalf. They, then, handle the day-to-day business.
At present, the regulations around the cannabis industry make franchise dispensaries difficult to come by. As policies and state licensing change, though, franchises will be inevitable.
Whether you’re looking to start a boutique or a vertically-integrated multi-store operation like Terra Tech, your success in cannabis retail requires you to imagine your future before you open your first store. What model do you want to achieve, and how do you plan to get there? With that decision out of the way, you can move on to the harder task of sorting through your local laws and regulations – and starting the process of getting a license to grow, process, or distribute in your state.
NJ edges closer to legalizing recreational cannabis after breakthrough on taxing

New Jersey is poised to legalize adult-use marijuana within weeks, after Gov. Phil Murphy and state legislative leaders reportedly reached a tentative agreement on how to regulate and tax the program.
Murphy and state Senate President Steve Sweeney, both Democrats, had been deadlocked on a tax rate, with Murphy favoring a high retail sales rate.
The agreement reportedly calls for a sales tax based on weight or quantity, such as per ounce of marijuana sold.
“We’re extraordinarily excited,” Scott Rudder, president of the New Jersey CannaBusiness Association, told Marijuana Business Daily on Monday.
“The principles of the agreement are in place; the next steps are to put it in writing and make sure everyone agrees.”
A tax on weight, NJ.com reported, protects against falling prices by keeping the tax the same regardless of price.
If the tax is $42 per ounce – said to be the tax rate that’s being discussed – it would stay the same whether the ounce cost $300, $150 or even $50.
Rudder said he hadn’t heard a specific tax number.
The current legislation will need to be amended, then passed by the full Legislature, a process that could be done within a few weeks, Rudder said.
“I do believe we have enough votes,” he said. “A lot of people are holding out giving their firm public position until they see a final bill.”
New Jersey’s adult-use cannabis industry is expected to generate upwards of $1 billion in sales a year once it matures.
Rudder said that based on the current bill and the tentative agreement, “we expect it to be a very robust industry and limited licensure to make sure we have a balanced approach.”
Here are a few details:
A tax on weight would provide some revenue stability even if marijuana prices decline, as has been the case in other states that have legalized adult use.
The current bill provides for licenses based on market demand and would permit marijuana delivery services.
Many aspects of the industry would be left to a cannabis control commission, including defining those license limits.
“We’re going to see a lot of different entrepreneurial opportunities and opportunities to invest,” Rudder said. “The ancillary market is getting ramped up as well.”
Rudder said law, security, marketing firms and others already are regearing their business plans for an adult-use market.

Former House Speaker Boehner gets behind marijuana lobbying group

Former U.S. House Speaker John Boehner announced a new, industry-funded group to lobby for marijuana reform in banking, taxes and research, a move that will put a political heavyweight behind the MJ industry’s efforts to overhaul federal cannabis policy.
The National Cannabis Roundtable will consist of members representing all aspects of the industry, including growers, processors, retailers, investors and entrepreneurs, Boehner told reporters.
The lobbying group will represent cannabis businesses in 23 states and the District of Columbia, Axios and The (Cincinnati) Enquirer reported.
“As the cannabis industry grows and matures, it’s vital that we work together for a common-sense legal framework for cannabis policy,” Boehner said in a news release.
He will advise the group and serve as an honorary chair, but he will not work as a registered lobbyist.
Boehner, a Republican, is a former marijuana opponent who had a change of heart, last year joining the advisory board of New York-based multistate cannabis operator Acreage Holdings.
Since then, Boehner has been outspoken about how the federal government shouldn’t interfere with state-legal businesses.
Acreage will be among the National Cannabis Roundtable’s clients, according to The Enquirer.
The roundtable comes at a time when several different groups are going hard at federal reform.

The Cannabis Trade Federation, formed last year, hired 15 lobbyists for an all-out press at passing the States Act – legislation that would allow states to develop their own marijuana policies without federal interference.
The National Cannabis Industry Association is throwing its weight behind legislation that would enable legal cannabis businesses to have access to banking services without fear of repercussion. The industry group is collecting written testimony in advance of a hearing on a draft marijuana banking reform bill Feb. 13 held by a subcommittee of the U.S. House Committee on Financial Services.
Attorney General nominee William Barr has pledged a hands-off policy toward state-legal marijuana businesses. While Barr remains an opponent of marijuana legalization, he wants the disparity between state and federal laws to be resolved.
