Been extremely busy lately with my semi real job. Trying to keep a client out of jail and this time it is not Sharkey. That's a full time job that comes with its own set of problems.
A couple of things from the sidelines. Isn't the cosmetics industry regulated by the FDA? If so, good for us for the next move. Not sure what the "Walk the talk" award is but it sounds impressive.

Today there will be no losses with trade volume way below our average over the past week. Care to wager on that. One percent of your stake vs. a 10th of one percent of mine. That's about as even as I can come up with.

Great news today pps shoots straight up at the open then a steady decline. I guess some folks are taking profits and I don't blame them for that, or some other screwing going on. But I think the news is exactly what we have been waiting for and what has been expected by many of us.
It will be interesting to see where we go from here. Can't wait to see what the inevitable newcomers will say about how this is a "honeypot" which were I come from is usually filled with turds. You need to be careful self gratifying posts. Depending on where, how and who's could get you into more trouble than even I could get you out of.

Can some you more learned folks explain what happened today. My extremely novice take on today is that there was some profit taking at the open this morning up until mid day. Seems to me we had a nice recovery off the bottom of approx. $3.25 to the close. Really low volume for such a swing IMO. But I'm somewhat ignorant on these things. Ok maybe not somewhat. Any edification would be appreciated.

Yea Otis, You can call me anything you want ( not you specifically unless you want too) just don't call me late for supper. I've been called much worse than a dumbass before. Hell my clients and family (sometimes they are the same) call me all kinds of things. But it usually doesn't cost me money. I'm tempted to add some shares with this "pull back". But not sure if that is wise pending earnings report. I do expect a record Qtr. as has been discussed here. But you know how my trading goes. Seems like for every ten shares I add the pps drops equally.

To say I'm a novice investor would be an insult to novice investors. I am grateful to this board for allowing me to hang around despite my half assed attempt at comic relief mostly at your expense. I have learned so much from this board as a groupie than I ever did in the few business classes I took in College or the articles in Forbes, Barrons, Business Weekly, etc., mostly looked at the pictures. But I have to say I don't know WTF is going on. I liked some of the prognostications about why we were dumped on but sometimes I feel like a mushroom. Always kept in the dark and up to my neck in sheet. Your claiming charm and wisdom would be most appreciated at this time.

We have come a long way since I've been with you'll. I know it hasn't happened as fast as most of us thought and we still have a long way to go. But things seem to be going the way we all anticipated. Got turned on by Patrick Cox a few years back. (Not that way). Did my DD and really liked what I saw. Took some advice once from Pat Mcgroin, a relative of yours I think and almost had to sell the family jewels to get out of hock. (Beating up on you is to easy. Not much pleasure in it for me anymore). Enough of my BS. I hope I haven't just screwed the pooch for us with my praise.

I take no offense. These law firms sound like corporate versions of ambulance chasers. Not my area but I suspect that the law firms will evaluate the issue and determine if a class action would be profitable for them. Those cases generally don't require fees upfront. They are done on a contingency. Meaning that any monetary award would include a percentage for the law firm and then the rest would be divided up among the parties to the lawsuit. Or the law firm submits to the Judge a request for attorney fees to be paid by those being sued. If an action is filed you will be contacted by the law firm and asked to join in the lawsuit. You can if you want but are not obligated too. If the lawsuit is unsuccessful then the law firm is out whatever their expenses were. Again not my area but that is usually how it works.

Certainly makes a good foundation for at the very least a criminal investigation. In my experience with any level of government, the more it makes sense the less likely it will be acted upon. The history of this person(s)posting BS articles under the guise of an opinion and saying upfront that he/she/they are short is all the more reason that at the very least the SEC should investigate this turd. Plain to see this is manipulation. Also because this has happened before on SA means they have had notice of these type of BS self serving articles that have done damage to company image and share price. The history of this guy or at the very least SA allowing these hatchet pieces that have damaged companies and shareholders. Why the SEC has not stopped this crap is beyond me.

Just because the "disclaimer" said it was an opinion does not necessarily mean that it can't be libel. Certain things were presented as facts, there were omissions, untruths. (Damn Lies). There is something in the law called Libelous per quod. There are things that are not actionable upon there face, but become so by reason of peculiar situation or occasion which the words are written. Publications which are not obviously defamatory, but which become so when considered in connection with innuendo, colloquium, and explanatory circumstances. There is also Libelous per se. ( defamatory on its face). When words are of such a character that an action may be brought upon them. IMHO there appears more than enough to bring an action against S A (scumbag assholes). If that is done then a lot of things about (scumbag assholes) can be revealed through discovery. Lawyer speak for digging through all of your shit. That would be fun.

Have to disagree with you AG. If the article is presented as factual and not opinion SA and or the author of the article may be guilty of libel. Add to that the admission of being short and it smells like manipulation to me. Collusion may be harder to prove, but erroneous facts in an article is another matter. Part of proving libel you must show the "facts" as presented are false and that a result of the erroneous facts as presented caused an injury to reputation and otherwise i.e. "Injury" in the form of a monetary loss. IMO both apply in this case.

I just saw this article. It was sent to me by email. Like like Corporate sabotage. Not my area of the law. But Seeking Alpha may only be liable if it published the article knowing it to be false or failure to do proper due diligence. I don't know how articles are posted or who has editorial responsibility but it is possible the could be in trouble. I hope someone has contacted APDN's PR person. More than pissed and ready to choke the shit out of someone.

Things have been moving at a very rapid pace these last few months. Best string of news that I can remember. About that accidental meeting with that counterfeiting Sum Beach. When you come up for some premium Carolina cabbage Skunk root hybrid I'm sure we can make it happen. Not going to waste my good stuff setting that hump up. I can get some of my clients to get me something that will work just as well, and they will do it as payment for whatever I'm representing them on. About that last issue. I'm not taking the bait about your wife. We tried that once before and she said she wouldn't be seen with a backwoods country lawyer like me. Especially when she found out I'm from Arkansas and living in NC. Said her reputation was already in the crapper being with you and I wouldn't improve it one bit. She may still be mad about what happened the last time you and I met up. Talk about a big bust. We got thrown in jail when I saved that women's life that was choking when I did that hind-lick maneuver. It worked but she didn't like my technique.

You're right Mike. When it comes to this kind of stuff Justice is rarely swift or Just. Unfortunately it takes something along the line of a Madoff or Enron for anyone to get the right amount of time. Have to really hurt someones pocketbook or at least the right person to warrant a real sentence. Then they send you to a pretty nice "confinement facility" to do your somewhat but not really "hard time". Madoff is here in North Carolina last I heard. The Potential death of some G I 's is hardly worth the trouble to some.
