According to the definition above, the underlying reason for the move into the Grey Market is because of "lack of investor interest, company information availability or regulatory compliance". Given that the OTC Pink tier itself also has lots of securities that suffer from "lack of investor interest, company information availability or regulatory compliance", I would assume that broker-dealers tolerate this "lack of investor interest, company information availability or regulatory compliance" for quite some time before actually pulling the plug.
The real question is will the latest revelation make this stock worth over $1?? That’s the question one should ask.
Unless this goes over a $1, it’s too early to celebrate pal.

Well, after rereading page 40 of the presentation, I am suddenly starting to think that this stock will in fact wipe out shares. It seems as if none of the equity will be left for shareholders ("33% of the equity to new money and 67% for old money"). From this, I would advise to selling and not buying. I think NMC as a company will be fine though. The company is too big to fail and is still even opening new facilities. However, in my opinion I don't think current shareholders will be fine though and will be wiped out altogether. However I hope I'm wrong and wish the best for anyone still holding, but I would assume based on page 40 that any current shares will literally be worth nothing. I will be keeping an eye on this stock and may buy back if things change, but it doesn't look good for shareholders now.
The most likely scenario is to issue new shares when they are coming out of bankruptcy and use the money recovered from the fraud to pay back their biggest creditors. With clean accounts, they will get re-listed and issue new shares to investors.
Page 36 and 40 of the presentation indicate that as part of the reorganization, all 100% of NMC equity will be allocated to bondholders (33% of the equity to new money and 67% for old money) and that any recovered funds will be distributed to funders, bondholders or re-injected into the company.
That to me is clear of common shares being neglected.
While it is pretty certain NMC will not go into insolvency. But common shares would be wipe out and they start with new listing. Be careful folks.

Dubai court issues worldwide freezing order on BR Shetty’s assets
The founder of NMC Health, BR Shetty, has had a worldwide freezing order placed on his assets at the request of a lender that claims he has defaulted on a loan of more than $8 million (Dh29.4m).
The order was granted to Credit Europe Bank (Dubai) last month ahead of a claim filed at the DIFC Courts against Mr Shetty, New Medical Centre Trading and NMC Healthcare.
The lender said in its claim they “are jointly and severally liable” for the repayment of money initially secured through a credit agreement in December 2013 and renegotiated in December last year. Credit Europe Bank is an Amsterdam-headquartered institution specialising in trade and commodities finance with operations in nine countries.
The credit agreement was guaranteed by two security cheques which the bank said in its claim were signed by Mr Shetty – one drawn on his personal account and another on the account of New Medical Centre Trading – that have been "dishonoured upon presentation due to
insufficient funds".
The bank claimed Mr Shetty “has now fled the jurisdiction of the UAE to India” and that there was a risk of his “substantial” assets in the Emirates being dissipated
The assets frozen include properties in Abu Dhabi and Dubai, as well as shares in NMC Health, Finablr, BRS Investment Holdings and other companies.
