The Race For A Cure For Cancer, The Final Chapter

The race for a cure draws closer with the recent shift of utilizing immunomodulatory or chemotherapeutic agents alone, to adding immunotherapeutic agents in combination with these agents. Immunotherapeutic agents activate our own immune system to locate, recognize, target, and destroy cancer cells. Over many years of evolution, cancer cells have been able to evade our immune system by the use of biologic camouflage, and therefore our immune system has never been able to attack cancer cells because they were not recognized as foreign material for destruction.
Recent research and development from leading pharmaceutical companies has led to new approaches, utilizing monoclonal antibodies, in creating "true" immunotherapeutic agents. These agents can be broken down into two groups; upstream immunotherapeutic agents, and downstream immunotherapeutic agents. Downstream agents currently developed are; Anti-PD-1, Anti-PD-L1, and Anti-CTLA-4 which I covered in my previous article. These downstream agents are products in the pipelines of; Bristol Myers (BMY), Merck (MRK), and Roche (OTCQX:OTCQX:OTCQX:RHHBY). The only upstream immunotherapy agent is bavituximab, in the pipeline of Peregrine Pharmaceuticals (PPHM). Upstream immunotherapies are far superior to downstream therapies, and in fact downstream immunotherapies have been shown in pre-clinical models to be synergistic when used with bavituximab. New human clinical trials using bavituximab in combination with downstream agents are currently being started, and results are expected to be blockbuster.
According to Peregrine Pharmaceuticals web site; "Bavituximab is a first-in-class phosphatidylserine (PS)-targeting monoclonal antibody that has demonstrated broad therapeutic potential across multiple oncology indications and represents a new approach to treating cancer. PS is a highly immunosuppressive molecule usually located inside the membrane of healthy cells, but "flips" and becomes exposed on the outside of tumor cells and cells that line tumor blood vessels, causing the tumor to evade immune detection." This "biologic camouflage" of cancer cells has been supported by over 1500 peer reviewed publications, and has been the recent focus of many scholars in the oncology field.
Bavituximab targets and binds to PS, thereby blocking the cancers immunosuppressive signal, and has been shown to reactivate the body's immune system, restoring its ability to recognize and destroy cancerous tumors. Bavituximab has been shown to nearly double survival over standard of care in second-line breast and second-line lung cancer in phase II studies.
Of special note, many chemotherapeutic agents increase the amount of "flipped" PS in the tumor micro environment, thereby increasing the binding site for bavituximab. Examples of such chemotherapeutic agents include docetaxol, sorafenib and paclitaxcel. Currently, investors and oncologists are anxiously awaiting news of Peregrine Pharmaceuticals' preliminary read out of median overall survival of two IST trials, one combining sorafenib with bavituximab for treatment of liver cancer and the second a breast cancer trial combining paclitaxcel with bavituximab. At last year's ASCO meeting Peregrine Pharmaceuticals presented preliminary data of bavituximab in combination with paclitaxcel and showed complete responses "cures" in 15% of patients to date. Are the complete response numbers growing in the breast cancer trial? Will bavituximab show strong survival benefits when combined with sorafenib for treatment of liver cancer? These are the questions that will be answered soon.
Peregrine Pharmaceuticals has made tremendous progress over the past few months with the bavituximab oncology program, gaining FDA Fast Track status for the treatment of second-line NSCLC. Peregrine Pharmaceuticals was recently featured on CNBC noting their drug bavituximab as the next potential blockbuster drug to treat cancer. CNBC noted that 100% of drugs that recently received priority review from the FDA had gained approval. Peregrine Pharmaceuticals could potentially apply for accelerated approval at anytime, and produce bavituximab for commercialization through its owned subsidiary and in-house bio-manufacturing unit Avid Bioservices, which provides development and biomanufacturing services for both Peregrine and outside customers.
Peregrine Pharmaceuticals has recently increased its cash position to 90 million through a preferred share offering, which is enough to fully fund their phase III "SUNRISE" trial in second line NSCLC. Investors of Peregrine Pharmaceuticals are now focused on the next few weeks with ten conferences scheduled. The conferences will focus on the safety and efficacy of bavituximab, and the potential as the new leader in the immunotherapy space. Topics will cover current clinical trials underway from cancer to HIV, as well as a plenary session on the world stage in Germany. Peregrine Pharmaceuticals has quickly become noticed through the out-reach work of their KOL's (key opinion leaders) Dr. Scott Antonia of the world recognized Moffitt center and Dr. Dimitry Gabrilovich of the Wistar institute, who recently were added to Peregrine Pharmaceuticals staff of medical advisors.
Peregrine Pharmaceuticals is currently not partnered, and owns the licenses to all patents for all agents that bind to PS. Investors are anxiously awaiting news of whether or not Peregrine Pharmaceuticals will receive accelerated approval for bavituximab in 2014, or partner with a large pharmaceutical company then apply for accelerated approval. With accelerated approval of bavituximab in hand the marketing for this next potential blockbuster drug could begin in 2015 and sales of bavituximab for second line NSCLC and possibly breast and liver cancer could exceed 2 billion annually.

Preferred stocks are technically stock investments, standing behind debt holders in the credit lineup. Preferred shareholders receive preference over common stockholders, but in the case of a bankruptcy all debt holders would be paid before preferred shareholders. And unlike with common stock shareholders, who benefit from any growth in the value of a company, the return on preferred stocks is a function of the dividend yield, which can be either fixed or floating.
Preferred stocks are either perpetual (have no maturity) or are generally long term, typically with a maturity of between 30 and 50 years. In addition, many issues with a stated maturity of 30 years include an issuer option to extend for an additional 19 years. Investors considering purchasing a perpetual preferred should ask themselves: Would I purchase a bond from the same company paying the same interest rate with a 100-year maturity? The answer should be no, because the maturity is too distant.
The very long-term maturity of preferred stocks with a stated maturity also creates a problem. The historical evidence on the risk and rewards of fixed income investing is that longer maturities have the poorest risk/reward characteristics -- the lowest return for a given level of risk. The long maturity typical of preferred stocks isn't the only problem with these securities. They typically also carry a call provision.

George Soros, the billionaire hedge-fund manager who has broken the British pound and some Republican hearts, is betting that the U.S. stock market could break, too.
Soros Fund Management had $1.3 billion wagered at the end of 2013 that the Standard & Poor's 500-stock index would fall, the Bullion Baron blog reported last week, citing the fund's latest regulatory filing. It was Soros' biggest position, making up 11 percent of his fund's holdings.
The filing is a snapshot of Soros' position at the end of the fourth quarter of 2013. He might have raised or lowered that bet since then. He might also be using the position to hedge some other bet. He's certainly not going to tell us. Closing out the bet would have made some sense in the middle of February, after the S&P had fallen more than 5 percent for the year.
But Soros definitely jacked up the bet going into the end of the year, to $1.3 billion from $470 million in the third quarter. And just last month he warned about risks to the global economy, mainly from China.
Soros is maybe most famous, or infamous, these days for being sort of the liberal version of the Koch Brothers -- a wealthy guy pumping millions into progressive candidates and causes.
But he has also been a fairly savvy investor over the decades, most famously making $1 billion on a successful bet against the British pound in 1992, an event still known as "Black Wednesday" in the U.K..
In case you're thinking of ignoring Soros because of politics or because hedge funds are absolutely the worst at predicting the future, keep in mind that his fund was the best-performing fund in the world last year, according to a ranking LCH Investments.
And after that brief 5 percent swoon in late January-early February, the stock market has bounced right back to its record highs, capping a nearly uninterrupted tear since March 2009. Most terrifyingly, ordinary investors are starting to tiptoe back in -- always a worrisome sign.
An old guy and his bucket of shrimp
It happened every Friday evening, almost without fail, when the sun
resembled a giant orange and was starting to dip into the blue ocean.
Old Ed came strolling along the beach to his favorite pier. Clutched in his
bony hand was a bucket of shrimp.
Ed walks out to the end of the pier, where it seems he almost has the world
to himself. The glow of the sun is a golden bronze now.
Everybody's gone, except for a few joggers on the beach. Standing out on
the end of the pier, Ed is alone with his thoughts . . . and his bucket of
shrimp.
Before long, however, he is no longer alone. Up in the sky a thousand white
dots come screeching and squawking, winging their way toward that lanky
frame standing there on the end of the pier.
Before long, dozens of seagulls have enveloped him, their wings fluttering
and flapping wildly. Ed stands there tossing shrimp to the hungry birds.
As he does, if you listen closely, you can hear him say with a smile, 'Thank
you. Thank you.'
In a few short minutes the bucket is empty. But Ed doesn't leave.
He stands there lost in thought, as though transported to another time and
place.
When he finally turns around and begins to walk back toward the beach, a few
of the birds hop along the pier with him until he gets to the stairs, and
then they, too, fly away. And old Ed quietly makes his way down to the end
of the beach and on home.
If you were sitting there on the pier with your fishing line in the water,
Ed might seem like 'a funny old duck,' as my dad used to say. Or, to
onlookers, he's just another old codger, lost in his own weird world,
feeding the seagulls with a bucket full of shrimp.
To the onlooker, rituals can look either very strange or very empty. They
can seem altogether unimportant . . . maybe even a lot of nonsense.
Old folks often do strange things, at least in the eyes of Boomers and
Busters.
Most of them would probably write Old Ed off, down there in Florida. That's
too bad. They'd do well to know him better.
His full name: Eddie Rickenbacker. He was a famous hero in World War I,
and then he was in WWII. On one of his flying missions across the Pacific,
he and his seven-member crew went down. Miraculously, all of the men
survived, crawled out of their plane, and climbed into a life raft.
Captain Rickenbacker and his crew floated for days on the rough waters of
the Pacific. They fought the sun. They fought sharks. Most of all, they
fought hunger and thirst. By the eighth day their rations ran out. No
food. No water. They were hundreds of miles from land and no one knew
where they were or even if they were alive. Every day across America
millions wondered and prayed that Eddie Rickenbacker might somehow be found
alive.
The men adrift needed a miracle. That afternoon they had a simple
devotional service and prayed for a miracle. They tried to nap. Eddie
leaned back and pulled his military cap over his nose. Time dragged on.
All he could hear was the slap of the waves against the raft.
Suddenly, Eddie felt something land on the top of his cap.
It was a seagull!
Old Ed would later describe how he sat perfectly still, planning his next
move. With a flash of his hand and a squawk from the gull, he managed to
grab it and wring its neck. He tore the feathers off, and he and his
starving crew made a meal of it -- a very slight meal for eight men. Then
they used the intestines for bait. With it, they caught fish, which gave
them food and more bait . . . and the cycle continued.
With that simple survival technique, they were able to endure the rigors of
the sea until they were found and rescued after 24 days at sea.
Eddie Rickenbacker lived many years beyond that ordeal, but he never forgot
the sacrifice of that first life-saving seagull. And he never stopped
saying, 'Thank you.' That's why almost every Friday night he would walk to
the end of the pier with a bucket full of shrimp and a heart full of
gratitude.

PS: Eddie Rickenbacker was the founder of Eastern Airlines. Before WWI he
was race car driver. In WWI he was a pilot and became America 's first ace.
In WWII he was an instructor and military adviser, and he flew missions with
the combat pilots. Eddie Rickenbacker is a true American hero. And now you
know another story about the trials and sacrifices that brave men have
endured for your freedom.
As you can see, I chose to pass this on.
This is a great story that many don't know . . . You've got to be careful
with old guys, you just never know what they have done during their
lifetime.

Washington (AFP) - President Barack Obama's health care law suffered a new blow Monday, as his administration delayed a key component requiring small businesses to provide insurance to employees or face a fine.

The decision was the latest glitch to Obama's signature domestic achievement which has been plagued by political attacks and a disastrous debut for a sign-up website.
Department of Treasury officials writing rules for the Affordable Care Act decided that business with fewer than 100 workers but more than 50 would have an extra year -- until 2016 to offer health care to employees or face a fine.
The requirement, known as the employer mandate had already been put off by one year.
"While about 96 percent of employers are not subject to the employer responsibility provision, for those employers that are, we will continue to make the compliance process simpler and easier to navigate," said Assistant Secretary for Tax Policy Mark Mazur.
Firms with over 100 employees will get more time to complete the insurance process but will still have to start paying a fine for some workers in 2015 if they fail to offer health insurance to workers.
Republicans seized on the new adjustment to the law to accuse Obama of usurping his powers to cover up for what they see as the health care reform's failure.
"The White House seems to have a new exemption from its failed law for a different group every month," said Mitch McConnell, the top Republican in the Senate.
"It's time to extend that exemption to families and individuals -— not just businesses."
Republicans are making controversy over the health care law the centerpiece of the campaign to win mid-term elections, in the hope of taking back the Senate.
As well as the website debacle, Obamacare was also hit by the president's now discredited promise that if Americans liked their existing plans and doctors they could keep them.
Obama however argues that after early glitches, the law is gathering pace.
He says nine million people have now signed up for new insurance policies or joined an expanded Medicaid program for the poor.
He also touts reforms that now prevent private insurance firms from turning away patients with pre-existing conditions from taking out new policies.
Children of policy holders who are not in full time work can now remain on plans held by their parents until the age of 26.

WASHINGTON (AP) - The Obama administration has eased the rules
for would-be asylum-seekers, refugees and others who hope to come to the United States or stay here and who gave "limited" support to terrorists or terrorist groups.
The change is one of President Barack Obama's first actions on immigration since he pledged during his State of the Union address last month to use more executive directives.
The Department of Homeland Security and the State Department now say that people considered to have provided "limited material support" to terrorists or terrorist groups are no longer automatically barred from the United States.
A post-Sept. 11 provision in immigrant law, known as terrorism related inadmissibility grounds, had affected anyone considered to have given support. With little exception, the provision has been applied rigidly to those trying to enter the U.S. and those already here but wanting to change their immigration status.
For Morteza Assadi, a 49-year-old real estate agent in northern Virginia, the law has left him in a sort of immigration purgatory while his green card application has been on hold for more than a decade.
As a teenager in Tehran, Iran, in the early 1980s, Assadi distributed fliers for a mujahedeen group that opposed the government of Ayatollah Ruhollah Khomeini and was at one time considered a terrorist organization by the U.S. government. Assadi said he told the U.S. government about his activities when he and his wife applied for asylum in the late 1990s. Those requests were later granted and his wife has since become a U.S. citizen. But Assadi's case has remained stalled.
"When we are teenagers, we have different mindsets," Assadi said. "I thought, I'm doing my country a favor."
Assadi said he only briefly associated with the group, which was removed from Washington's list of terrorist organizations in 2012, and that he was never an active member or contributor to its activities. Now he's hopeful that the U.S. government will look at his teenage activities as "limited."
His lawyer, Parastoo Zahedi, said she has filed case in federal court to force U.S. Citizenship and Immigration Services to process Assadi's green card application, but now hopes the government will act on its own.
"In the past, the minute your name was associated with a (terrorist) organization you were being punished," Zahedi said. "Not every act is a terrorist act and you can't just lump everyone together."
The Homeland Security Department said in a statement that the rule change, which was announced last week and not made in concert with Congress, gives the government more discretion, but won't open the country to terrorists or their sympathizers. People seeking refugee status, asylum and visas, including those already in the United States, still will be checked to make sure they don't pose a threat to national security or public safety, the department said.
In the past, the provision has been criticized for allowing few exemptions beyond providing medical care or acting under duress. The change now allows officials to consider whether the support was not only limited but potentially part of "routine commercial transactions or routine social transactions."
"Refugee applicants are subject to more security checks than any other category of traveler to the United States," Homeland Security spokesman Peter Boogaard said. "Nothing in these exemptions changes the rigorous, multilayered security screening we do."
The change does not specifically address "freedom fighters" who may have fought against an established government, including members of rebel groups who have led revolts in Arab Spring uprisings.
In late 2011, Citizenship and Immigration Services said about 4,400 affected cases were on hold as the government reviewed possible exemptions to the rule. It's unclear how many of those cases are still pending.
Sen. Patrick Leahy, chairman of the Senate Judiciary Committee, said the rule change will help people he described as deserving refugees and asylum-seekers.
"The existing interpretation was so broad as to be unworkable," Leahy, D-Vt., said in a statement. He said the previous rule barred applicants for reasons "that no rational person would consider."
Republican lawmakers argued that the administration is relaxing rules designed by Congress to protect the country from terrorists.
Rep. Bob Goodlatte, chairman of the House Judiciary Committee, called the change naive given today's global terrorist threats.
"President Obama should be protecting U.S. citizens rather than taking a chance on those who are aiding and abetting terrorist activity and putting Americans at greater risk," said Goodlatte, R-Va.[color=red][/color]
Holder’s same-sex marriage move heats up separation of powers debate

Attorney Eric Holder is making sweeping changes about how the federal government extends rights to legally married same-sex couples, in areas where the Justice Department has jurisdiction. The move should add more fuel to the debate over the roles of the executive, Congress and the states in deciding social issues.
The official policy statement will come from Holder on Monday, but news of it leaked out on Saturday before Holder made a public speech in Manhattan on Saturday night.
Holder, in the latest series of steps promised by the Obama administration, will issue a Justice Department policy memo. The directive will say that same-sex couples, who are legally married under the laws of a state that recognizes such unions, should receive equal benefits and treatment in areas like federal lawsuits and the U.S. court system, as well as in federal prisons.
“This means that, in every courthouse, in every proceeding and in every place where a member of the Department of Justice stands on behalf of the United States — they will strive to ensure that same-sex marriages receive the same privileges, protections, and rights as opposite-sex marriages under federal law,” Holder said at the Human Rights Campaign’s Greater New York Gala at the Waldorf Astoria in New York.
The move comes almost three years after the Justice Department said it wouldn’t defend the Defense of Marriage Act (DOMA) in court and about seven months after the Supreme Court said a key part of DOMAwas unconstitutional under the Fifth Amendment, in the United States v. Windsor case.
Two groups opposed the move, issuing statements questioning the Justice Department’s policy directive as infringing on states’ rights or overstepping the Executive’s constitutional authority.
“This is just the latest in a series of moves by the Obama administration, and in particular the Department of Justice, to undermine the authority and sovereignty of the states to make their own determinations regulating the institution of marriage,” said Brian Brown, president of the National Organization for Marriage, said in the statement. “The American public needs to realize how egregious and how dangerous these usurpations are and how far-reaching the implications can be. The changes being proposed here .?.?. serve as a potent reminder of why it is simply a lie to say that redefining marriage doesn’t affect everyone in society.”

Occasionally companies use preferred shares as means of preventing hostile takeovers, creating preferred shares with a poison pill (or forced-exchange or conversion features) which are exercised upon a change in control. Some corporations contain provisions in their charters authorizing the issuance of preferred stock whose terms and conditions may be determined by the board of directors when issued.
