going from 858 to 231 to 516 is confusing but:
what i understand them doing is wanting the newly issued patent language to clarify language in the other patent(s) for claim construction purposes.
my problem is that the need for clarification suggests infringement and damages at (any) trail may not be as cut and dried as i previously thought. if it isnt clearly stated now, where does that leave us?
seems to me if it didnt need added support it would be settled now as opposed to second trial. just disappointed in the delay and think gers is coming around in spite of the litigation.
certainly agree with that. just conerned with the proposition that the infringement claim needs additional support, and icm's possible defense.
... no sooner than october?
whats got me wondering now is the need for inclusion of the new patent language.

i agree the end result may depend upon the reasonableness of the respective claim construction arguments on appeal but believe that question is also leaning in gers favor if for no other reason than that prudent licensees are increasingly outnumbering infringers.
seems the question is not simply whether the infringers will settle or appeal but may well include a determination of whether they and their attorney want to appear before the court of appeals and make unreasonable and obstinate arguments why ... a [punitive] damage award should be set a side.
i may be naive but nonetheless remain optimistic that settlements will ensue.

looking for companies that crashed and had yet to recover from the recession. given the national trend, gers looked like a good candidate. the more i read the more i liked and bought. moved the decimal as farr as i could/cared/dared with 10.5m. if i could afford to buy more i probably would.
i dont think it will take much to move 14m shares upward and expect both the litigation and the next 2q's to be favorable. if it dont turn out right, i will deal with it ... then --- but not until then. no point ruining today and will go do some fishing instead.
