Intel Corp., the largest chip maker in the world, has asked a federal judge in San Francisco to declare that it is not infringing on a microprocessor patent held by one of San Diego's smallest companies.
Intel filed suit Wednesday against Patriot Scientific, a tiny Rancho Bernardo company with negligible revenue and eight employees.
By filing the case, Intel has moved to take control of patent litigation that Patriot initiated seven weeks ago against five Japanese companies that manufacture desktop and laptop computers, DVD players and other products.
In each case, Patriot claimed that computers and other products sold by the Japanese manufacturers infringed on one of its key patents because every product contains an Intel processor.
In the patent suits filed against Sony, Toshiba, Fujitsu, NEC and Matsushita, Patriot is seeking hundreds of millions of dollars in damages.
"What they're saying is that our microprocessors infringe" on Patriot's patent, said Chuck Malloy, a spokesman at Intel's Santa Clara headquarters. "We don't believe they do."
Intel has asked a judge to declare that Intel's chips do not infringe and to prohibit Patriot from suing, or threatening to sue, Intel or its customers for infringement.
"Intel is basically saying that our business is sufficiently affected that we are going to go out and fight this," said Jay P. Kesan, who teaches intellectual property law at the University of Illinois College of Law in Champaign. "That, of course, is going to be of great comfort to Intel's customers."
Intel's entry into the case represents a massive challenge to the validity of his company's patents, said Jeff Wallin, Patriot's chief executive.
"We're delighted," Wallin added. "It will focus the litigation on the merits of our patents."
In a statement issued yesterday, Patriot said it likely will countersue Intel for infringing its patent for a variable-speed system clock that synchronizes the microprocessor's internal operations with external instructions.
In its 15 years as a public company, Patriot has never shown a profit as it tried to commercialize various technologies – including its 32-bit Ignite microprocessor.
By weighing in on the patent litigation, Intel is taking control of the case, said John E. Gartman, a San Diego lawyer who specializes in patent litigation.
"Intel probably sat back and said, 'You know we're going to be next. Why don't we choose where we want to litigate, rather than where they want to litigate.'"
He referred to the federal court in San Francisco as Intel's "home court," saying more technology patents get scrutinized in that district than any other federal jurisdiction.

Germany's Beate Uhse has eyes on 'Penthouse' owner

FRANKFURT, Jan 29 (Reuters) - Europe's leading sex shop chain, Beate Uhse (XETRA:USEG.DE - News), said on Thursday it had offered $62 million to buy General Media Inc., the bankrupt publisher of U.S. men's magazine Penthouse.
Beate Uhse, named after the former Luftwaffe female pilot who founded it in 1946, said it had a strategic interest in the publisher, which would help establish the German firm as an international player.
"With our purchase offer we are strictly following our international expansion plans," Chief Executive Otto Christian Lindemann said in a statement.
General Media, which is currently 99.5 percent owned by parent firm Penthouse International Inc. (OTC BB:PHSL.OB - News), filed for Chapter 11 bankruptcy protection in August. Penthouse International has not filed for bankruptcy. Penthouse, founded in 1965 as a competitor to Hugh Hefner's Playboy and known for its raunchy content, has seen sales plunge in recent years to newer, more celebrity-oriented men's magazines geared at a younger audience. Readers have also been lured away by a growing array of pornography on the Internet
