Attitude Drinks was founded in late 2007 and began trading publicly in August 2008. The prior decade for me was a very challenging and ultimately rewarding commitment as President and CEO of a small public company called Bravo! Brands, Inc.. My vision then, as it has been throughout our first 7 years here, involved developing functional and “leading edge” ready-to-drink (RTD) beverages. Specifically, my focus has been on milk and protein delivery due to two primary realities. First, milk is Mother Nature’s most perfect food and provides a myriad of unique functional attributes. Second, milk and milk protein drinks remain the last frontier in terms of dominant branding in the beverage sector.
My bachelor’s program of study was in Business Administration at the University of Maine at Orono and 40 years ago I learned that a clear and consistent definition of marketing is simple; “find a need and fill it!”. Since 1997 my goal in building beverage brands has been channeled toward that objective. Here at Attitude Drinks we see very clearly how American consumers continue to move away from RTD’s which deliver only hydration or refreshment (especially sugar laden drinks). Consumers favor those which provide either experiential or nutritional functionality. In other words, people want to know what their drink will do for them! The good news is that once consumers find a “legitimate solution to a genuine need” they are happy to pay reasonable prices for the functionality. We observe the annual sales declines in sugary/bubbly refreshment drinks while simultaneously watching sales acceleration in sports drinks, energy drinks, fortified water, and healthy juice drinks along with protein drinks! The beverage industry has always been exciting and rewarding to successful brands but, as one reviews the big winners in the industry, successful beverage brand development always takes time!
Phase III is in my opinion the most advanced and sophisticated brand in the protein delivery industry today. I know that’s a bold statement and I make that claim with considerable experience in this category. Consumer friendly and shelf stable milk RTD’s are tough enough to produce let alone adding the scientific balances of functional uniqueness for specific use occasions. Phase III is developed to cover each and every need for genuine recovery from physical activity and facilitate lean muscle growth. Attitude Drinks developed and introduced this drink in a way that delivers science, convenience, mouth feel and most of all, great flavor. We produce Phase III in America’s leading milk processing facility where we access state of the art technology in filtration, sterilization and packaging. Phase III Recovery is truly one-of-a-kind and we are very proud of our product.
My business experience spans nearly four decades and during my career I have become a student in business development and leadership. I have founded and managed six companies in my career and worked in and around the securities industry as a securities broker or principal from 1982 through 1997. I have managed micro-cap public companies ever since. During those years I have identified only two practices or attributes which have consistently determined success in business and leadership. They aren’t magic potions or brilliant insights; they are simple adherence to integrity and persistence. During my career I was fortunate to meet with two of the world’s most powerful leaders and I learned that even those great men embraced these very same behavior guidelines in every successful endeavor.
Attitude Drinks, Inc. continues to work through economic challenges and headwinds but I know that we prioritize the most important ingredients for success. This management team is committed to persevere with Phase III and other new products which are superior in their space in the beverage category. We recently grappled with updating our public reporting to re-state “non-cash” errors in our financials. While the changes took five months and resulted in our reporting a multi-million dollar improvement in our results, the process clearly impacted our share price and company momentum. We persevered.
Thank you for being part of our adventure and know that while success in this industry is a “marathon, not a sprint”, your management team here at Attitude is determined to keep our focus on long term success and those two special tools.
Thanks again for supporting us through this challenge. Next month I will review some specific plans for our near and long term growth as we continue to build our business.
Roy G. Warren, CEO
He hasn't received the trademark yet. Cytosport was challenging it and Roy did an express abandon which means he can file for it again after a certain amount of days. Cytosport is now being sued for using the term milk in Muscle Milk. Alot happening in southern Florida right now. ATTD.
Thanks, I know Roy is trying to get the Milk With An Attitude trademark and thought he might go ahead and use the name without the trademark. ATTD
Did she say why they are putting new labels on the cans? ATTD
In what town did you buy Phase 3 at an X Sport? This is the first I have ever heard they were carrying Phase 3. ATTD
I think the next big news we will hear will be about Milk With An Attitude. If Roy can get that trademark I believe we will hear about national distribution. People can relate with the name MWAA. I wouldn't know what Phase 3 is by the sound of it. ATTD
I have not. The only thing my buddies have said is that he told them he is sitting on news, he wouldn't comment about it any further. I figured if he isn't telling them, he isn't going to tell me. ATTD
I have had no problems speaking with Roy. All I can tell you to do is to continue to call him until you do get the opportunity to speak with him. ATTD
Last time I called the transfer agent there were just over 300 million shares issued. 56,000 and some change restricted. ATTD
I have a couple of online friends who have spoken to Roy recently and Roy told them he is sitting on the news to release. You would think if he had something to release he would do it.
I am hoping Roy gets the Milk With An Attitude trademark soon and releases whatever news he has associated with that. ATTD
Ask why Phase III is unable to be located on the King Supplements web site. How long until we can expect to see it on there or is the product sold out? Ask if Roy would be willing to buyback shares instead of a reverse split. Would Roy be willing to retire some of the authorized shares? Does he expect to go through all 20 billion? Would he retire 17 billion of them? ATTD
Nothing new from that call. It reads as if it were scripted by somebody involved in marketing.
I am curious as to why the caller didn't ask about the Milk With An Attitude trademark and what Roy is doing with that. ATTD
I was thinking that the issued shares would be closer to 400 million after that huge volume day last week. ATTD
Roy finally did name McClane as a distributor. I am not sure if they are distributing the product anymore. Other than Florida and Boston I don't know where P3 is being sold at in stores. I can't find it anywhere. ATTD
I think we might see .0001 before .0025 today. ATTD
News out!! We may not be dead after all. ATTD
Roy started diluting again, no bid by next week. ATTD
I can see it now. Used a different computer. ATTD
I don't see anything but an "X" so what is suppose to be on this chart? ATTD
Still no dilution. How is Roy paying any of the bills? Is he issuing convertible notes for everything? ATTD
What is your source for this? ATTD
As each day passes I am starting to realize that a buyout isn't happening. Maybe a company is going to partner with Roy? I agree with you that the only place P3 can be bought is Amazon. I have been calling around the east coast to those same chain stores and P3 is no longer sold in any of them.
Dr. Pepper doesn't have a product anywhere near the quality of P3. Maybe they partner with ATTD.
The Milk With An Attitude trademark will be interesting. Now that Roy dropped his puruit of it and if Cytosport is sold will he try to get it again?
Roy could always change the packaging size(smaller)and material and lower the price. Then it might be competitive.
The only way ATTD is going to make money is with national distribution, the east coast only distribution isn't going to pay any bills. There is no way Roy can go national on his own. He needs someone to front the cash to produce the product.
I don't think Roy is diluting again. I don't see the volume like we had in the past. I have seen the volatility in the price over the last few weeks with very little volume. I have called the transfer agent a few days after that and no dilution.
Here is what I don't understand. Roy has those restricted shares that are worth a bundle. He issues himself options in September. I realize he doesn't have to act on those options but why even bother with the options? If ATTD is bought out can he be told kiss your restricted shares goodbye you have to retire them?
I don't think Roy is gone, I think Roy is being told what to do. I had a conversation with Roy years ago about the name Phase 3. I thought it sucked and still do. If I hear the name Muscle Milk I have a clue as to what it might be but Phase 3 means nothing to me. He got angry, he said he would never change the name. Now he is trying to acquire the trademark for Milk With An Attitude. He recently abandoned the attempt. Once Cytosport is sold he may try to get the trademark back because Cytosport might be less likely to challenge him.
In the Q it said all management members are working without a written contract. I don't know if that has bee in past Q's, I don't recall seeing that. But that tells me that If ATTD is bought out they are all gone unless offered a contract.
Before Roy can do any converting he is going to have to release some news to get the pps up. If he begins to dilute or convert this will be no bid again. ATTD.
Roy and anyone on the management team no longer have written employment agreements with ATTD.
Read the latest Q. I don't think Roy is CEO anymore. ATTD.
I wonder if Roy is declaring bankruptcy tomorrow now that he is current? ATTD
No the float is around 180 million. ATTD
If Roy wants to trade ATTD like anyone else I don't have a problem with that. What he would do in the past is dilute himself shares and then sell them. That I have a problem with.
Look at the restricted share count. It hasn't increased or decreased. Roy kept those out of the r/s so they are worth quite a bit. Other than the options I don't know what else he has in terms of share count because ATTD isn't current.
He has shares, he hasn't cashed any in. ATTD
The only thing he can be padding his pockets with is cotton balls because the company isn't making much money. ATTD
There is still no dilution. Sell while you can. This is a scam. Every company dilutes and ATTD isn't. Sell sell sell.
Sell sell sell. American Bulls sell sell sell. Barcharts Sell sell sell. The financials are on Roy's desk ready to be released anytime he wants to release them. ATTD
You don't do a reverse split on 181 million issued shares. What a joke!! ATTD.
If Roy has no money coming in why are the doors still open? Why hasn't he declared bankruptcy? Why not just file the most recent Q and call it a day? Where is Roy getting the money if he isn't diluting shares? What pumping have I done? I haven't told anybody to buy ATTD. I prefer if they sold all of their shares and sent this back into the trips so I can load up even more shares. ATTD.
The company hasn't diluted since late November. Where is the scam in a sub penny that hasn't diluted in five months? What proof do you have of a scam? ATTD.
The fact that you lost money doesn't prove that this company is a scam. What proof do you have that this company is a scam? ATTD
