We won a small battle today, the secured creditors and the debtor were pushing for an expedited hearing before Jan 31 on their standstill/settlement agreement. Both the UCC and the ESHC objected that this was to important to rush through. The judge has set a date of Feb 16th for the hearing now.

but because of the selloff it is at $2.55 a real bargain IMHO if you can get them. This was very lightly traded at .10,so I expect it to be very thin post split. Keep in mind samsung and insiders own the vast majority of the stock. I will try and get some definite numbers, but I suspect the actual float to be less than 2 million shares post split.
I think the moisture content is supposed to be around 5%

Indeed, the process is designed to keep everything fair and everyone honest. Most times, many hundreds of thousands or even millions of dollars are involved.

As I understand it, the settlement process is actually very formal. The con is laid out and a grid placed over it, samples are taken from each square, then combined and samples taken from that and given to all parties including an "umpire" Each party does their assay's and when its time for settlement, they stand in front of their fax machines and press GO at the same time. The results are compared and an agreement reached. Any disputes and the umpire is brought in.

Guys I appreciate the offers of help and support, but we have it covered for now. Lee Abbott is someone involved in this and a unsung hero behind the scenes in our efforts, and does not get nearly enough recognition, if/when we are ultimately successful he will deserve a LOT of the credit.
I agree he made good points as well. The first race I ever attended was the 1993 Daytona 500 and I became a DJ fan that day. I have been trying to find a replacement favorite driver ever since he retired but have not settled on anyone yet. LOL I am leaning towards Kyle Busch..... I know, I know, couldn't be a more different personality than DJ, but despite being an a$$, the kid is a hell of a driver and hangs it out there every race. I still wear my DJ gear around proudly,(including an awesome white leather jacket) and am really glad he is now in the broadcast booth.

For the year ended December 31, 2010, consolidated net sales were $48,601,000, an increase of $3,750,000 or slightly more than 8% compared to consolidated net sales of $44,851,000 for the prior year.
Net sales at AIM were $40,477,000, an increase of $1,123,000 or nearly 3% from net sales of $39,354,000 in the prior year. Net sales at WMI were $8,124,000, an increase of $2,627,000 or nearly 48% from net sales of $5,497,000 in the prior year.

NASCAR’s current system awards the winner 185 base points, with a 15-point difference from first to second, a five-point difference from second to sixth, a four-point difference from sixth to 11th and a three-point difference from 11th to 43rd. Five bonus points are awarded for leading a lap and leading the most laps.
That is rather complicated, the 43-1 system does seem to be easier to follow.
I have sent Rincewind a bunch of docs to post, some of them are a little confusing, the big deal in all of it is the secured creditors have agreed to settle for an amount far less than the amounts of their claims. Once they are posted read through them and I will try and address as much as I can. Also note that the UCC along with the ESHC are objecting to certain parts of it. Again, I think getting a number on paper from the secured creditors is the best part of the docs. I expect to put out an update from the ESHC early next week.
I think the market may be reacting to some new filings,I will get them out shortly.

MAXJDA: There are 3 full time employees at the mill, they are maintaining the equipment (starting all the trucks, bulldozers etc) keeping stuff greased up, turning over the mill equipment, winterizing stuff etc. I know they cleaned the scavenger cells recently and did a lot of reclamation work on some disturbed land. The mill is not made to be left alone to gather dust, it must be maintained and looked after. In addition Dave McMullin and Dave Hartshorn are there every day as well, in fact DM has been working full time since last May without pay.

I was not trying to cheerlead, its just I have seen all the comments about the secured creditors, unsecured creditors, and amounts of money owed to each etc etc etc
Just because I cant comment or respond to specific allegations or questions does not mean that the ESHC is not aware of all the issues and parties involved.
Regarding some of the questions and comments over the last few days, I would love to lay out specific and detailed responses but legal restrictions and issues of privilege and confidentiality make it all but impossible. I will point out some content from previous updates from the ESHC that address's some of it in general terms.
"Since its appointment, the ESHC has met with the numerous major constituencies in the case, including the debtors, secured creditors, Nevada Star, and the official committee appointed in Western Utah Copper Company’s bankruptcy case to represent the interests of unsecured creditors. The ESHC has advocated in favor of a plan of reorganization (POR) that will include the interests of current shareholders and that will be supported by all major constituency groups."

"The ESHC is in the process of negotiating with numerous parties to obtain support for a global, consensual POR. The success of such a POR is contingent on the ESHC obtaining financing not only sufficient to exit bankruptcy, but also to allow the company to go into production."
