( OTC PINK : AGTK ), a leader in compassionate care technology and agricultural solutions for the recreational cannabis industry, today announced that the voters of California approved Proposition 64 on Tuesday evening, now making California the most populous state in the nation to legalize the recreational use of marijuana.
The approval of the ballot measure, which led in recent polls, would essentially create the largest market for marijuana products in the United States.
"We are very excited that citizens of California voted to end the failed policy of marijuana prohibition," said Nate Bradley, executive director of the California Cannabis Industry Assn. "Proposition 64 will allow California to take its rightful place as the center of cannabis innovation, research and develop."
The initiative of Prop 64 will allow Californians who are 21 and older to possess, transport and buy up to 28.5 grams of marijuana and to use it for recreational purposes. The measure would also allow retail sales of marijuana and impose a 15% tax.
With financial support from former Facebook President Sean Parker and New York hedge fund billionaire George Soros, the campaign in favor of Prop 64 was able to raise close to $16 million, about 10 times the money brought in by the opposition.
Lt. Gov. Gavin Newsom was the face of the campaign, arguing that the national "war on drugs" has failed while disproportionately hurting minority residents and wasting law enforcement resources.

With the upcoming November election will set the tone for this sector including recreational approval in the two states of California and Nevada. Agritek Holdings based on our rapid growth and experience within the sector, has recently been offered a new capital infusion from various funds exceeding $500,000 starting next month. Agritek Holdings based on state guidelines to be determined, could participate in the ownership and sale of wellness products within the state similar to rules set up and approved for public companies in Washington State, Nevada and Oregon. Puff, Puff…Pass?: Proposition 64 is California’s mark of progress
If cannabis is legalized recreationally in California after Nov. 8’s election, the entire Pacific Coast of the United States will allow the possession, consumption and cultivation of marijuana — a federally illegal drug.
Legitimacy is the theme of cannabis legalization. Activists say access to cannabis is a civil liberty; some doctors consider it natural medicine. Entrepreneurs are salivating at the the potentiality of capitalizing on legal cannabis, using modern marketing techniques to appeal to targeted audiences and creating newer business models to make their profit.
Here’s where conservatism comes into play: The Drug Enforcement Agency says it has no medical value — lack of research, continuation of studies to see long-term effects and historical fear of drug abuse have all contributed to their ruling — hence its scheduling as a Class I drug, along with heroin and LSD.
Yet, the sales of cannabis is nothing new for medical patients. Proposition 215, passed in 1996, decriminalized possession for all medical marijuana patients allowing licensed cannabis consumers to buy marijuana from any dispensary in person — only if the municipality and local law enforcement allowed the dispensary.
Now, they can order cannabis online from delivery services or in person from professional dispensary storefronts, all specifically marketed to target audiences that were unforeseen: elderly, young parents, working professionals and athletes, alike.
But Proposition 64 clears the air about the decades old stigma of marijuana. If passed, adults over 21 will be able to sell, cultivate and consume cannabis in private spaces. There won’t be any police raids or arrests, as long as you stay out of educational zones and public places.
If passed, how do we make it legitimate?
The question is: If the proposition is passed, how will the cannabis industry prove its worth and characterize itself differently from every other existing industry?
Looking at the effects of legalization in the four recreational states and the District of Columbia, legalization seems to be treating city governments awfully well. The excise taxes from sales and cultivation are levied by governments and the revenues go back into the city — drug prevention programs, youth education, research and funds toward rehabilitating the environmental damage caused by prior illegal growing.
The concern with making marijuana legal in California is the next step — what will become of the industry? Businesses may grow, maximizing their profits along the way and mass-producing cannabis plants.
If marijuana is new to you, corporatization probably doesn’t pose a threat. But long-term users and small businesses already have a steady relationship with craft cannabis. After the prohibition of alcohol in the early 20th century, emerging corporations capitalized on legalization: distributing mass-produced, low-grade beer and spirits at each corner liquor store.
This is exactly what prolific cannabis consumers hope to avoid. If anything would be worse than not capitalizing on the benefits of the cannabis industry, it would be turning the industry into a twin of Big Tobacco or Big Alcohol, with a few major players controlling the production and distribution processes. The appeal of craft cannabis would be tarnished. The culture would be upheaved.
There is a culture surrounding high-end marijuana use; cannabis connoisseurs are often attracted to the farm-to-table aspect of the industry. They want to know how their marijuana is grown, how it is dried and cured, what strains will alleviate their symptoms and how they will experience the product. The domination of low-grade, mass-produced cannabis would be a nightmare to the average MMJ patient.
Small businesses have already demonstrated their ability to market and distribute products to a particular niche of high-end consumers — legalization would offer these businesses a gateway to normalization. Contemporary names attract customers and aesthetic websites use high-definition photos to show the detail in flower buds and extracts. Social media and iPhone apps encourage consumers to buy-in on promotional deals by offering discounts, two-for-one deals and location services to hone in on consumers. These businesses even sponsor cannabis festivals and conferences, as well as advertise in regional newspapers. The weed industry has officially hit 2016.
Despite the success of the current market for medical marijuana, full legalization will not be easy given concern from local governments, neighborhoods and law enforcement. But it has been said to help reduce criminal activity, prevent incarcerations for minor drug possession, and ease cash-strapped deficit run governments.
Californians can consider Proposition 64 as a means to safely access marijuana, or their medicine for that matter. No underground market, no illicit means to acquire marijuana to smoke. If anything, transactions become safer, your cannabis becomes safer, you become safer.
Considering that California’s ballot includes the option to vote for stricter gun control, the use of condoms for pornography and the repeal of the death penalty, 2016 highlights our Golden State’s progress in comprehensive social reform. Proposition 64 is not only progressive in its acceptance of widespread cannabis use, but it also serves to reform the legacy of an inequitable drug policy that targets communities of color. The war on drugs highlights the disproportionate focus from law enforcement and our nation’s criminal justice system: People of color are far more likely to be stopped, searched and arrested for drug possession than white people, regardless of all races’ comparable drug use.
The emergence of legal cannabis in California can help provide opportunity to people of color, now more than ever.
I spoke with Steve DeAngelo, cannabis activist and founder of Oakland’s Harborside Health Center, at a cannabis conference highlighting diversity and employment opportunities in Oakland on Oct. 24.
Here’s what DeAngelo thinks:
There’s a need for jobs in the industry, whether you are a graduating college student or a mid-career person looking for a change. Anything from software to construction to finance to marketing, jobs will open up.
But there’s only one chance to create the industry the right way — what DeAngelo wants is for the cannabis industry to embrace diversity and sustainability. He believes in economic fairness as part of business models and wants all communities, especially communities of color, to be understood.
“If all that we do with this is create a new industry, shame on us, we’ve blown our greatest opportunity, because what we have an opportunity to do here is not to create a new industry but to create a new kind of industry, right?” DeAngelo said.
Ricky Williams agrees. The 1998 Heisman Trophy winner and former NFL-player-turned-cannabis-advocate was at the conference too, a keynote speaker discussing his personal journey dealing with athletic injuries and mental health since his college career.
During 11 seasons in the NFL, Williams was suspended twice for violating the substance-free policy, testing positive for THC. But, to deal with his chronic pain and emotional well-being, Williams would take a cocktail of painkillers among other pharmaceutical drugs. Marijuana worked best for him.
He doesn’t think athletic associations will change their stance any time soon on cannabis. If anything, the NFL will wait to allow marijuana until it becomes federally legalized. But Williams wants the NFL to at least raise the THC levels in drug tests, allowing players to use a small amount of marijuana without being penalized.
“I wouldn’t have won the Heisman without using cannabis,” Williams said. At hearing that, the folks around us cheered.

High Odds of Legalized Pot in California

In 2010, Californians rejected Proposition 19, a ballot initiative to legalize the growth, sale, and recreational consumption of marijuana, by a seven-point margin. What a difference six years have made. On November 8 a new pot legalization initiative, Proposition 64, is expected to win by a landslide.
And that, dear readers, is a safe prediction despite some evidence of a softening of enthusiasm for Prop. 64. Last month, the two most prestigious California public opinion outfits — the Field Research Corporation and Public Policy Institute of California (PPIC) — both pegged support for Proposition 64 at 60 percent. Field nostalgically noted that its first poll of California on the subject, in 1969, showed only 13 percent support for legalization.
A new PPIC survey in October showed legal weed pulling a mere 55 percent with 38 percent opposed. That’s still a 17-point margin. Indeed, there has only been one bad poll for Proposition 64:
A recent poll from the California Growers Association of 750 cannabis farmers found that just 31 percent supported Prop. 64, with another 31 percent opposing it and a whopping 38 percent undecided.
Ambivalence among pot farmers is partly attributable to regulatory costs associated with a legalization scheme, and partly to fears of getting crushed by big companies — perhaps alcohol producers and distributors who already have a system in place for getting the product to market. Those involved in the lucrative existing medical marijuana industry are especially nervous.
But it has always been hard to imagine that the Golden State would hold out much longer once pot became legal in other jurisdictions. Aside from California, Arizona, Maine, Massachusetts, Montana, and Nevada are holding recreational pot initiatives next month, bidding to join Alaska, Colorado, Oregon, Washington, and Washington D.C. as places where one can legally fire up or consume an edible. California’s the biggie, though. And this time, it won’t be close.

Here at Insider Financial we’ve spent the last week or so attempting to uncover and highlight some of the top cannabis exposures ahead of what is possibly the biggest binary event to ever hit the sector – the ballot out of California that will determine marijuana’s recreational legality in the state.

The company is up nearly 600% on its October open alone, but just pulled back around 15%. We think this is speculators taking profits off the table, and we think it’s a great time to load up an exposure in anticipation of further gains as the November California vote looms.
For those not familiar with the company, here’s a quick introduction.
Agritek develop and manufactures hemp/cannabis based products, primarily thorugh the processing of cannabis plants into cannabis oil, and the introduction of this oil into saleable consumables.
It kicked off its operations in the electronic cigarette space, with its Mont Blanc range, but has – across the last twelve months or so – pivoted to meet what analysts anticipate is going to be a massive increase in demand for hemp consumables.
There’s lots of different descriptions of what this company does/is doing right now, but we are going to summarize like this: Agritek has prepared, and is preparing, a suite of commercial consumable products that it intends to put on shelves in California when recreational legalization comes in to play. These products are basically everyday snacks, drinks etc., things like popsicles, and through various distribution channels and agreements, the company has a network in place to get these products on the shelves as soon as the California government gives the industry the green light.
“With over 200 dispensaries in the Los Angeles area alone, which is about equal to the amount in the entire state of Colorado, we have deals in place to be able to introduce, license and sell products with the help of celebrity branding that this market has never before seen.”
The company’s CEO, B. Michael Friedman, has set its CFO the task of bringing its financials in line with that of a fully reporting company, a process that is set to be completed over the next few weeks, meaning Agritek will be one of the only fully reporting public companies in the recreational marijuana space in California to have pre-arranged distribution deals in place for these sorts of consumables. Demand is going to be huge, and Agritek is going to be there to meet it.
Earlier this year the company embarked on a debt restructuring effort, targeted at eliminating bad debt, and is well on its way to successfully meeting this end. It’s got a grow facility in Colorado that just received a license that will essentially allow Agritek to grow an unlimited amount of marijuana at the facility, and there’s a second facility (also in Colorado) waiting on licensing to go through.
$500,000 in non dilutive capital just hit the balance sheet, which will go towards the above mentioned Colorado efforts, which will – in turn – provide a base ingredient facility for Agritek’s recreational sales items in both Colorado and, assuming a green light come ballot day, California.
So, what’s the downside? Well, it’s very much a binary event. If California says yes, companies like Agritek are going to soar. If the state says no, these companies are going to take a real hit. Which begs the question, what is the likely outcome? We think there’s very little chance Californian’s will vote no, especially in light of Colorado and Oregon already having voted in favor.

“California is the biggest potential market in the country and the passage of Prop 64 will create an explosion in the value of compliant medical marijuana dispensary and cultivation licenses in good standing… That’s the precedent we’ve seen in Colorado, Oregon, Washington State, Alaska and D.C., … I have no reason to believe California will be any different.”
The recent cash injection takes some pressure off shareholders near term, but we expect some degree of dilutive raise to take place if and when California votes in favor. This raise will go towards pushing products, however, so we expect a quick turnaround on value add fro the funds picked up.
