I don't think it will matter in the long run one way or the other.
Who cares if they issue a PR? The court ruling is the best PR they could get!
Thanks, Mr. S. Great news indeed!! Settlement time coming this Fall. Should be good times ahead. Thanks for being a consistent voice of reason throughout this whole ordeal....
Tooth fairy, huh? Have you listened to the cc?
Re the Biochar test shipments, the company can announce those shipments immediately since those are revenue producers ($70K)-hopefully multiples of more revenue to come from these initial shipments that will be in future announcements!
You're correct. Look how many new names showed up even today on this board. And they all talk about the next run, this week, etc, etc. Few even think about how awesome this company looks for the long haul as an industry changer. They're here to get in, "pump up" the share price, and then dump and off to the next "play." Talk about pumpers. LOL MM was exactly right on the cc re. share price. Who knows where it will be short term because of these games that go on. Eventually the numbers will be so overwhelmingly good, IMO, that we'll be able to get out of this "pinky la la land" we're in.
If you would do a little reading first, you would've seen this from last eve and reposted today, and not jumped on someone for being vague and pumping
Some Key Points I picked up from the cc:
-MM, JG and JJ are all very professional and knowledgeable about this business
-Friday shipped 2 test truckloads of Biochar-1 east and 1 west to a major retailer (300 locations) in the fertilizer business. Total order $70K. Will be announced early this week. Fully expect this to become a multi-million dollar order with daily truck shipments.
-Biochar is not only sold separately, but is sold in mixes
-time-frame for coming off pinks is late Oct to the end of Dec; audit already begun
-Reemphasized, No Reverse Split!
-Private Placement should be completed by end of summer; 24 month holding period; funding mainly to increase production of Biochar, but also to meet obligations to JV partners; avoids dilution; have not sold shares into the market. Getting additional funding from USDA and other Federal agencies. United Sorghum Fund is interested also.
Bioproducts- Allendale plant can use for stronger, lighter, waterproof plastics. Car makers putting pressure on JV partners already to open plants in Midwest closer to their manufacturing plants.
-Allendale Plant: to open 1st qtr 2015; initial plan was for 13,000 tons/year production of biocoal, but due to demand, seeking to leverage European deal to expand to 50,000 tons/year. Power broker ECEM will “take everything they can produce” for European users; have sublet part of their lease in Allendale to a wood pellet manufacturer who will pelletize biocoal as part of their sublease payments. Should be able to host site visits by end of year to video progress.
-National Sales Director- should announce this mid-week.
info not so much for him as for others that may need clarification.
I believe all they have to do to get off the pinks is regular reporting and be above .01-that's why the audit has already started. They ultimately will shoot for the big boards, which is more what you're talking about.
Great job, Phil. I also sent an email with pertinent info to Samaritan's Purse, asking for Franklin Graham or someone else in the organization to contact higher ups at CDC to request use of the Hemopurifier. They are a larger organization that has been working with SIM on the ebola outbreak, and may have more exposure and contacts than SIM.

It would sure be nice to hear of a favorable decision from the USPTO Circuit Court this coming week. That would frame everything else going forward.
Heros IMO. Fat lady hasn't even begun to warm up yet....
Thx Mr. S. Do you know what cable outlets will carry the commercial? As opposed to what many think, not a dead company at all. Still building brand awareness-now with Genstrip 50. I can't wait to get some court resolution...could put J&J on their final leg toward a settlement. Then DECN should have some serious capital to invest back into the business.
Thanks for clarifying-sorry for my abrupt response earlier. I haven't been here long enough (just this year) to know what that valuation is all about, but I don't think it's relevant to VGPR going forward, at least in the foreseeable future. As you stated, I do believe we're in for significant business opportunities and share price appreciation in the next year, so I am long also. At some point long-term, re-structuring shares will probably take place (ie. reverse split). MM has recently called off a planned RS, but I think that is only for the short-term. Hopefully we see good share price appreciation before any RS would take place-then we can get off the pinks.
Like repeating yourself? Read about the current company and come back in a year, huh?
I hope you all had a pleasant dinner with other, more important things to discuss than DECN! I'm sure you did.
Interesting tack re. J&J possibly using FDA to make life miserable for DECN and other competitors. I'm sure they will continue to pull out all the stops. Regardless, they are poised to lose in the courts, which will give DECN a jump start on their business, not just with Genstrip 50, but other products also. FDA doesn't control the international markets, even if they could make life miserable in the US. A win in court bodes well for DECN....
Too bad this wasn't settled sooner, but it sounds like the end is definitely near. I'd love to see a settlement north of $200M.
Thanks, as always Mr. S, for your insightful and informative post. I'm guessing that J&J would have 30 days to appeal the "final' ruling?
Also, you stated:
"I am going to hedge my prediction just a little. I am saying October-November for a cease of hostility and reparations to be paid."
Would the cease of hostility be court ordered? And by reparations, you mean the bond only?
Thx G. Maybe Mr. S's partner has some additional info that would be helpful since the case is still pending??
Yes. June 17th filing, June 19th post by Mr. S.
Mr S- Have you heard updates re. any USPTO rulings?
"As a follow up to the post of this fine legal descriptive article, I am posting the link below. This link takes the reader to the transcript of the oral arguments made before the USPTO as they stand prepared in the next 2 weeks to rule on the applicability of Lifescan/J&J's patent. If the USPTO rules against Lifescan the litigation involving DECN is all over but the shouting.
The arguments for DECN were persuasive and that court has already ruled once against Lifescan/J&J in a rather hard manner.
As I have written in the past, my partner is a retired IP counsel and he is still sticking to his guns that the litigation will flip in the next two weeks and J&J will be spending the remaining days of this litigation on the defensive, not only against DECN but also against other competitors who will choose to attack J&J's patent portfolio using the same methods used by DECN.
October-November settlement, with each word written in the USPTO court ruling adding to the settlement price."
I wouldn't be surprised to see something settled w/ JnJ this Fall. Mr. S has been pretty right on with many of his comments-may be correct again. Good times will return here IMO.
I agree wholeheartedly! Looks like they're cleaning up the books as a necessary prelude to bigger and better things.
"I am more focused on other growing growth stories benefiting the world."
I still think DECN will do very well and will be a huge benefit to many diabetics. Another of my favorites to benefit the world is AEMD-could be the standard of care for many diseases in the future. Hopefully, both do well.
Been here 5 years-in it for the long haul, but expect significant progress in the next year. DECN may surprise us all !!
How does that saying go..."the borrower becomes the lender's slave??"
Frankly, can you blame longs for not posting?...there hasn't been much to post about. However, look at how many posted last summer and fall...it can turn on a dime...
Thanks for the great post. I like the part when you said, "It is what it is. You haven't seen anything yet."
I'm long because of the potential of this company. Short-term, all kinds of games are played with the stock-but long-term, I look forward to great things from VGPR in what could very well be a huge market.
Great news for VGPR! Too many whiners and doubters....GLTA longs.
Exactly. I don't care so much about the pps short term as long as the business is being built the right way. Indications are that is happening, so pps will take care of itself down the road.
Great News this AM. IMO, much more on the way!
Good to hear from you, Mr. S. Still hangin tough here, waiting for the good times to roll...I hope something good will happen within 2 weeks, but I don't expect anything (like reportable revenue) til at least late in the year.
IMO, here's what really kills stock prices of small companies-found on another ticker. It's not a level playing field when you're working against MMs-never has been:

"Naked Short Selling Is Killing OTC Companies 1 comment
May 23, 2012 11:15 AM
Shorts are alive and well and, the OTC Markets haven't seen the kind of rampant short pressure that is more and more commonplace today. Small development stage companies, and even profitable companies are being negatively attacked and sucked into a trap of naked short selling, which ultimately sends their stock prices plummeting, and often to the point of no return.
According to OTCShortReport.com a leading data provider of Naked Short Position information, a higher than normal number of companies are contacting them with questions ranging from who is shorting my stock to why are their securities being shorted so heavily. As a data provider, OTCShortReport.com doesn't know who's behind the shorting, but suspicions are it's Market Makers who are operating on a completely different playing field, are taking advantage of the rules.
Market Makers, unlike Brokers, can simply create shares out of thin-air that quite frankly cease to exist under the guise of creating liquidity and keeping markets rolling. The problem is when a Market Maker decides to send your stock in a downward direction, that's it, your company is going down. It doesn't matter whether you try to short squeeze the heck out of them or not, in the end, they always win.
Recently, ISM International (PINKSHEETS ISML), a victim of short selling, was so fed up with the abusive practices taking place with their stock, they contacted OTCShortReport.com regarding the possibility of creating a documentary to expose what is really happening. Only yesterday 73% of ISML was shorted for no apparent reason. Orders come into the stock, and Market Makers simply short against them, and then show up on the bid at much lower prices-waiting like predators. "I spend a great deal of the day explaining to my shareholders that we are being attacked. I have complained to the appropriate authorities, but no one seems to care," says Mario Quenneville, CEO of ISM International.
Naked Short Selling is also a common practice on penny stock promotions. Look at companies like SNPK, POTG, and current promotion GWBU. The short positions in these stocks are huge. Market Makers are building massive short positions in the dollar range, and effectively staying naked-short until these promotions get crushed, and give them the opportunity to cover in the sub-penny range. Of course, these Market Makers face no borrowing fees or lending contracts like regular Brokers, so essentially it's just the wild, wild-west where they know full well they can do whatever they please.
OTCShortReport.com executives say it's not uncommon to see 50% of a stock promotion being shorted. The big traders have lots of money… a lot more than the retail audience, and there is no urgency to cover these positions. Market Makers can't be scared into covering because quite honestly they don't care. A stock can run up 500% and they have proven they will just short more.
We invite investors to take a look at what is happening with this illicit naked short selling practice at www.otcshortreport.com
Feel free to query any OTC Stock you wish, and you'll be surprised at the amount of information you will find.
Disclosure: I have no positions in any stocks mentioned, and no plans to initiate any positions within the next 72 hours."
This is all great stuff! I love the acronym for the infant dialysis machine- CARPEDIEM- literally means "seize the day." I'm hoping soon for AEMD to do the same with the great progress they're making!!
Hope so!
AEMD looking good!
LOL! Oh well, we won't hear about how it went for some time.
Are you planning to "pop in?"
