What Lion should have said is some traders may be selling for their own purposes, but investors are holding and/or buying DECN IMO. Most selling is on low volume, pretty typical for manipulating the pinks. Low volume may exist now, but watch volume go to the moon as soon as a settlement is reached.
Man, as a long, I've been buying! Good prices down here-should benefit me greatly in the long run as DECN gets untracked.

They have no patent-DOA. If they appeal, the pain only increases and the court costs and settlement cost goes up-they worsen their position. They'll settle soon. The court cases JnJ has lost are proof enough for me. Prove that JnJ has any case moving forward-they don't!

Mr S, thx for the update re. JnJ's pending appeal to the USPTO Circuit court. Any idea if the court makes a decision to invoke Rule 36 much quicker than the 3 weeks allowed (Oct 22nd) or do they go up to the deadline?
I've been in business for years and I would NEVER show a contract with a customer to someone else, without the customer's explicit approval. Bad business, bad practice, bad results.
Why would anyone at the company do that? That would violate confidences with a customer. Suffice it to say, it's in a legal document (10Q) backed up today by oral statement by the CEO as confirmed by Lion.
The contract promises to ship to Walmart what they need once the anti-trust behaviors of JnJ are put to rest for good. S-e-t-t-l-e-m-e-n-t t-i-m-e approaching rapidly and lots of bucks to DECN will allow production and shipping for a long time to come. All IMO!!
Isn't it great that we have confirmation from the CEO today that the contract with Walmart is still in effect. Can hardly wait for the court proceedings to end and those shipments to begin!
Consider it hearsay or whatever you wish. The fact remains it is filed in a legal document, which makes it fact and all opinions to the contrary, hearsay.
Then the friend of the cousin of the uncle is lying, because a shipment hasn't been sent, although there is still a contract in place. That's been stated all along and verbally by the CEO today. And shipments haven't been sent because of issues surrounding the lawsuit filed by JnJ. But, mind you, that can change in a short period of time.
Quite a "coincidence" that the verbal statement matches up with the legal statement filed in the Nov 11, 2013 Q, huh? Amazing how that works!!

JnJ is truly fighting an uphill and losing battle. The longer it goes, the more uphill and expensive it gets. All IMO.
I'm sure most are aware of this excerpt from the November 11, 2013 Quarterly Report:
In June 2010 the company was approached by the largest retailer in the world for the distribution and sale of Genstrip at over 5,000 retail stores worldwide. A contract with this retailer was negotiated in September 2010 and subsequently renegotiated and renewed in April 2011 and then again in July 2013, and as soon as the retail contract was agreed to and as a means to conduct market research, the company began seeking pre-conditioned letters of intent (pre-orders) for Genstrip, while continuing the prosecution of the 510(k) application before the FDA. During this process it became clear that initial market interest in Genstrip outstripped the initially available manufacturing capacity. Thus the company quickly ended its pre-order initiative. In September 2011 the company was sued by two divisions of pharmaceutical giant Johnson and Johnson....
So there you have it stated in a legal document for all to see that Walmart pursued the company, obviously because DECN has great value to offer Walmart with their product, and they have entered into contracts and renewed same, most recently in July of last year. This company has not issued PRs to "pump up" a contract with Walmart for good reasons; neither would it produce evidence of the contract to please skeptics on a message board. LOL No shipments have been made while the company has been in legal limbo due to lawsuits JnJ has filed, which are about to come crashing down on JnJ BIG TIME, IMO, after being crushed in the USPTO and in the Circuit Court. The tide is turning rapidly and I will be here, fully invested to enjoy the results. Yes, and if JnJ is foolish enough to appeal this last court decision, I will just have to wait a little longer to see justice carried out against them--but I don't think this goes on more than 2 more months or so.
Mr S, thanks a lot for sharing your tack on where this is going. I guess we'll know more by next Tues/Wed re. JnJ's request for stay on the USPTO ruling. If no request for stay, perhaps the timeline for a settlement moves ahead by a couple of weeks.
It sounds as if the demand to have DECN accept a payout for pulling Genstrip50 off the market is a non starter, which I would expect. End game coming soon, and IMO, it won't be pretty for JnJ.

Lion, what do you think will happen to the share price for DECN if the company gets a $50M settlement from JnJ? How about $75M? What about $90M? Very distinct possibility of $90M with the win in the USPTO Court with triple damages applied!
The only thing that matters right now is the imminent settlement with JnJ!

Speaking of settlements, I asked my partner as he was going out the door tonight what a fair price was. I am sure he wanted to get out but he told me without hesitation that $50-$60 million in cash perhaps augmented by potential anti-trust damages, and $2.50 in stock or approx. 1 million J&J shares.

You're probably correct re. company to company grant of JnJ stock-I guess wishful thinking on my part. We should get some idea soon what's been going on behind the scenes re. a settlement, hopefully by the 17th since this is week six since the hearing. Good times ahead IMO.
As you say, wouldn't it be great if the pot is sweetened by JnJ as we get closer to judgement day? We won't know if that's the case or not til we hear something and the dust settles. Hopefully within a couple of weeks we'll know more. I'm sure that just the fact that triple damages apply has already "leveraged" any settlement significantly. Not only will we see DECN sp increase significantly from a settlement, but hopefully part of the settlement will be in grants of JnJ stock for each shareholder of DECN stock. All IMO.
Unistrip--Over 40% given 3 star or less; 28% given 1 star. I'm glad I'm not using that product -pretty poor performance.

In November 2013 the Federal Circuit Court, reversed an earlier ruling made in late March 2013 by a District Court judge in Northern California, and ruled that the J&J Lifescan patent rights (under patent 7,250,105) were subject to the doctrine of patent exhaustion.
