It will be after. If the patents are sold at $121 million, then there will be $100 million surplus after paying off $21 million debt, which is about $0.50 per share.
I think the big shareholders will do that, unless of course they are on the side of bidding.
Therefore, small shareholders should do it.
What if the patents can be sold for $100 million or $200 million ......?

Can shareholders contact the RCPI lawyers as well as the bankruptcy court judge and advance the opinion about the value of the patents?
They should be informed about the testimonials of the Anatabloc users.
