As a long time BAC customer I'd love to see Ken Lewis get the boot. He's one of the few left after the shakeup. When I watched the last congressional hearings with the banking CEOs Lewis was one of my least favorites. Bank of America used to be basically a California bank. Those were the days.
APP NEW YORK (MarketWatch) -- Retail stocks headed lower Friday but American Apparel Inc. (APP:1.96, +0.47, +31.5%) bucked the trend after getting an $80 million investment from Lion Capital to help it weather several incoming loan obligations. American Apparel shares surged 34% to $2 in early trading. The S&P Retail Index ($RLX:262.18, +3.12, +1.2%) was down 0.4% to 258.01.

Bipartisan House group introduces bill to create pathway for approval of biotech-drug copies
NEW YORK (AP) -- A bipartisan group in Congress wants to give the Food and Drug Administration power to approve copies of costly biotech drugs.
Rep. Henry Waxman, a Democrat and chairman of the Energy and Commerce Committee, and Republican Nathan Deal introduced legislation to create a pathway for the approval of copies of biotechnology-based medical treatments. Biotech drugs are made in living cells.
There is no regulatory process for approving such copies in the U.S. That leaves the drugs' makers insulated from the generic competition the traditional drug industry faces. President Obama called recently for the creation of a regulatory pathway.

Goldman identifies banks it sees paying off TARP soonest

NEW YORK (MarketWatch) -- Analysts at Goldman Sachs on Wednesday identified a group of banks that they say are in good capital shape and are likely to pay off government TARP money ahead of rivals. They suggested clients buy a basket of those stocks, while selling the broader KBW Bank Index (BKX:
22.65, +3.05, +15.6%) . Goldman's basket includes Bank of New York Mellon (BK:, , ) , JPMorgan Chase (JPM:, , ) , Morgan Stanley (MS:, , ) , US Bancorp (USB:, , ) , Northern Trust (NTRS:, , ) , First Horizon ( (FHN:, , ) , Comerica (CMA:, , ) , and City National (CYN:, , ) . "While we think the regional banks, First Horizon, Comerica and City National, are likely to repay TARP in 2010 rather than 2009, these are banks with the most tangible common equity," the analysts said. They said that Wells Fargo (WFC:, , ) is not included in their because, "while it is relatively more healthy and certainly wants to repay TARP, Tier 1 ex-TARP is less than 6%. State Street (STT:, , ) is also not included, as tangible common equity is only 1.2% at 2008 year end pro forma for conduit consolidation."

GLD. Several months ago I heard Louise Yamada predict a future price of $3000 for gold. She is one of the few technicians with credibility.
FSLR into the gap
Bought some STT this morning. We get an annual check from them. Last year a big red flag went up for me when I was told by my bank there would be a 10 day hold on the check. Yesterday I was told the check would clear in 12 hrs.

GLD. Ico I also am looking at gold long term. I bought GLD in Oct @82.42 and wasn't going to touch it, but a few weeks ago when EVERYBODY was bullish on gold I decided to sell it @ 96 and get back in lower. I bought some @ 89.98 and will probably buy more today.
