DMO I would say you're probably spot on, basically. It is no surprise to anyone here that SP has been between a rock and a hard place.
We must assume the OS is very high and that Tivus is essentially tapped out without authorizing another x billions for which there are likely few buyers. Combine that with Philly--which (as far as we know) still has not committed in writing but has no reason not to, the ten facilities in India who are expecting installations to be done and advertisers to be signed up, and with hoteliers in the Caribbean who may at any moment get the local approval for the work..which they'd love to start .
Lots of good irons in the fire and you're out of coal. Hell's bells. What are you going to do? Put the fire out and go home or find more coal... or anything else that burns?
Sp is getting another baptism by fire. I say another becuase he has been in a tight spot in the past. He seems to have that "Never say die" attitude.
SP must know that even if he did do an RS it would be a more painful way to fall on the sword than going for debt relief via restructuring (bankruptcy) or putting his children up on Ebay. Well ,maybe not the Ebay thing. The reverse split would only sour people more. We have to think, then that Mr. Bickle sees the lay of the land and knows the way through it safely.

I have speculated before that , perhaps, the new guys buy up some stock BEFORE they sign on with the company. That way, the purchase does not have to be reported as insider buying. (God forbid we let anyone actually know the people trying to grow the company are actually buying company stock.) Maybe it is an oversimplification, maybe it is their friends doing the buying, maybe..most likely, I am 100% wrong, but it seems plausible.

Let me explain why we are sooooooooooo happy. First, when one comes to this forum and day after day we have to read what a criminal SP is and what a day in SEC history it's going to be when it finally comes to suspend Tivus for all of the egregious treasonous acts committed, it is not that much fun for starters.
Bear in mind, we longs tough it out month after month with no hard numbers with which to assess our investment other than the PPS, which, all by itself, can be something of what one might call a "bummer", if you catch my drift.
SO.... with this information now firmly in the forefront of your mind, imagine that some business people with track records and experience , having been approached by SP to come on board, look over the lay of the land, see what they see and -presumably with no firearm pressed into their temples- decide to join Tivus and to see if their talents can add some value to the venture.
It would be analogous to making a trip to Zeta Reticuli on impulse power only (which would take quite some years) and then along the way you suddenly get handed a freshly mined set of Dilithium crystals to load into your ship's power plant. Now the arduous journey has been reduced to the better part of one day. It makes you feel Soooooooooo happy.
Sure your crystals will wear out, but maybe before that happens, other good things might transpire and Zeta Reticuli is now just a fun place to drop by from time to time rather than being a multigenerational marathon with no worthy goal at the end of the trip.

FWIW..I think it is positive that there is new blood coming into the fold here. Of course, we have no idea ( because we are never allowed to know)how long either Mr. Brenner or Mr. Bickel have been at hand or how influential they have been in any recent developments, but suffice it to say that they are here, they have some experience and seeing what they see, they choose to be a part of it.

Mr. Scott wants to be a consultant, but I have have told him to wait just a bit. We have some drill coming up in a couple of weeks and something always fails during one of these drills. We need to have him handy and not distracted. He has an idea for a transparent CEO, which I think is brilliant.

Anyway... My expectation is this: I know SP wants to uplist at the earliest possible time despite all of those activities which have undermined this effort. In Mid October we should get out Q3. The Q3 should spell out how much more money Tivus is now making thanks to ad insertion at the very least in Philadelphia. (I expect it will be a pleasing bit of datum, really.)
If we get a decent board disclosed by the end of this month and the TA gets ungagged I would expect some sort of run, yes.
If anything, though, it has been a lesson in expecting the unexpected when it comes to Tivus. Every opportunity Tivus had to make a splash it shot itself right in the foot. Every single time..at least since I started snooping around in February or thereabouts.
From having seen how this market seems to work, a serious run can begin for no obvious reason. The company need not be sound, or even viable. We could all wake up and log on tomorrow morning and witness the start of a meteoric, historic run with no PR, no tweet (BTW there is no twitter feed on the website today. Why?)no rumor of anything at all.
A run is very overdue. It would not surprise me to see a run within the next few days. Honestly.

Mr. Kayne...I am 100% certain this is EXACTLY what we are seeing here. All of these men secretly met sometime before the of 2010 and they concocted this multi-year scheme to defraud as many investors as possible for as long as possible with a no-bid scam.

As for the dumping: SP addressed this in the CC. According to someone he called "management", ongoing operations would be financed by the sale of shares until such time as more conventional financing could be obtained.
Now, I don't know who this "management" is, but I actually thought it was him, but it would be inappropriate to refer to ones' self in another person in this context.
I must laugh at those who desperately want to price per share to rise but who post in negative, disparaging, even libelous terms for all new potential investors to read. I acknowledge a need to vent, believe me, I do. But it should be handled in a different way, IMO.
I had hoped that the shareholders made it abundantly clear in the CC that the frequency and quality of communication from Tivus MUST MUST MUST improve. For a short time it almost seemed as if we were going to enter a new stage of improved communications, but alas, this was short-lived.
For me, the reality is that because of how things have gone, I am "on hold" as far as investing any more. As long as there seem to be folks who are eager to grab up all those .0001s, I think there is reason to be hopeful.

Hello, all! Hadn't been around these parts in quite some time and I fully expected to learn that MDGC was shut down with lots of pending lawsuits and such. That it still exists in any manner says something about how such "companies" are monitored in terms of stock market activity anyway.
When I got out many months ago now I was sort of sad to do so because it had a good run after I left, but, alas, the run was built upon literally nothing but...well, lets just say "nothing".
To anyone considering making an investment here, I would say go back a good six months on this very board and read for a little while. Then compare what you have learned to what you expected to find.
Before the year is out, I would still bet that MDGC is closed for good. There are only so many times you can crank this machine with no oil or gas and expect power to be produced.

....and i would like it clarified why, if the BOD insurance was in place a week ago, why the board was not announced at that time. Did someone "waffle"? THAT is something we may never know.
I can tell you if I was in SP's shoes and had no idea who pissed in my Wheaties just when I was trying to eat a healthy breakfast to start my day..well, I would a most irritable Vulcan. Further I would spend some energy to find out what happened.
As I said in an earlier post, if a competitor really wanted to spook SP by doing this, it would not have taken too much money. They'd have gotten a decent bang for their buck. That being said, it would ONLY be undertaken by someone who viewed Tivus as a serious threat.
At this moment in timem from where we sit, Tivus does not come across as such a threat, but in the Gordon Gecko world where information is worth more than gold, someone may know something the rest of us don't yet...and they've seen fit to send a photon torpedo right into the USS Tivus' bridge.
It sounds like drama, but honestly ,we all know that when someone is sufficiently motivated, they can wreak horrible damage anytime and in any number of ways.
R3 is making some good points here, too. read some of his posts an cogitate on them.

..and for what it's worth...you don't run to your own neighborhood looking for a good opportunity to screw people. You go to show off. SP is a family man and surely has family in India. He is not going to take Tivus over there if the headlines are going to the last thing he reads before the local police come to take him to jail for defrauding his friends and neighbors in his homeland.
NO, I will stand by my regular assertion that SP is working as hard as he can to advance all prospects for Tivus. My hope now is that the incoming board can bring the clout and business sense Tivus has needed more of in the past. perhaps then we will get the sorts of Prs which clearer and more informative, worded to address obvious questions from the outset rather than raising them in the aftermath.
I feel I do need to sit down with an experienced broker for a few minutes to get a better understanding of how the numbers of shares I see in various categories move. It is not simple addition and subtraction as I used to think. It is way more sophisticated and less obvious...which is a shame. It should be completely transparent.

Expect the Unexpected.
This seems to be the rule of law here with Tivus. I will, for the moment, take SP at his word that the sale we saw yesterday was not his doing. Here is why. When you are trying to do everything in yor power to look like a "leading turnkey provider of IPTV technology in the hotel industry", then dumping all your bid support for your stock doesn't really make a great deal of sense does it?
I would be willing to bet he could find out whose behind it..and it would cause me little surprise that it is the handiwork of a competitor who saw a stunning opportunity to hand his competition a nice black eye for a very humble price. Maybe this makes me sound paranoid, but people will be miserable to each other when they are motivated to be so....especially when it comes to business.
As for the PR, they way it is edited or presented seems to be something of a recurring problem. It comes across as being ambiguous, confusing. I went into September thinking the board was completely seated and that procuring the insurance was the final step prior to public disclosure. Now, it seems that MIGHT not be the case. I don't think my view is different now because SP lied. I think the PR has some wording issues which are easily avoidable if anyone would just take the time to see the big picture prior to release.
If I go back and review other previous PRs, other examples of this odd ambiguity reappears. Perhaps it is nothing more than Enlish not being SP's first language. I am not sure.Most of us understand though that business is a very fluid environment and short of walking around with a master database in your head monitoring all details at all times, any CEO does the best he can at the moment when making a public statement.
It is completely laughable to see posts like "Tivus is dead, or Watch your back P., I'm coming for you. Before having any information, hit squads and assassins are on the streets seeking to take out this evil CEO...the devil incarnate, himself. Come on. We're not in 7th grade anymore, kids.
I'm as disappointed as anyone that my investment hasn't gone well with Tivus,but I still feel very confident that the service will do well, probably very, very well. Like Buffett says, forget about the day to day stuff, if it's a good investment, value will follow.
In other news, I drank McCOy under the table last night...badly. He is now getting rehydrated by nurse Chapel's liter of saline with vitamins. (loser.) Recall the SP said that someone called "management" determined that dilution would be how funds were to get raised until more conventional financing was an option.
My only problem with this statement is how he seems to place something called "management" into a sort of box. Well the problem is that SP IS management and attempting to place the blame for a questionable decision on "management" comes off as SP wanting to be excluded from liability for such a decision.
I know there is a board now. Management is this board..and they must've collectively looked at their present needs and declared this "dump' as the proper way to meet some financial needs.
While I do not know..or have a great deal of faith in SP's business acumen, I do have faith in Mr. Truckenmiller's. I am also hopeful that these other, still unknown, boardmembers are very experienced and business-savvy.( I do hope that the shift of Truvk from VP to consultant did not occur becuase he did not like some part of the make-up of the new board, but this is not anything we will know anytime soon I would imagine.)
I am going to sit tight, learn for all of this and see what comes of it. As I watch the various applications following Tivus, many things are happening I have never witnessed before so I hope to find out what it is all about.SOmehow, he has gotten Tivus from a concept to a contracted service provider to nearly a dozen hotels now so let's keep that part of all of this clearly in mind.
SInce SP now sees that when he does not communicate very well with those supporting Tivus, it turns into nasty posts for his children to read, perhaps he'll decide to offer some news that will help calm the nerves of everyone here who are as dumbfounded as I am.

I am not going to panic, at least not yet. SP did say we'd be spending dough on the India contract to get that ball rolling, We know that even though we have cash coming in, we don't know how much or how quickly. Further he also did day that the situation in Puerto Rico was moving forward...we may have to be spending some coin there as well to keep everything on track.
So while the shock of seeing a dump that big is curious, we owe it to ourselves to keep in mind we have contracts to honor. I'd much rather see that than to see Tivus get a bad rep in the industry just as it is starting to make real headway. This all may be little more than a bridge loan to get Tivus from point B to point C. We don't know. I do NOT for a second believe it is a sign of trouble.

Nobody can tell how thin it really is anymore. After weeks of countless millions of cheap shares showing up the minute 2s are sold one is left to conclude that the number of additional cheap shares could reach into the.....billions.

No doubt equipment and personnel are being secured to fulfill the India installations....as well as any other installations whose announcement are still pending. Ya gotta spend money to make it, no? And now that the board is appropriately and properly insured, there is every expectation that they'll hit the ground running if they're not already.
Tried my hand at barbeque-ing (sp?) on the holodeck. All the damn smoke detectors and sprinklers went off. I thought it was supposed to be a rather smoky sort of thing to do. I didn't have any chicken so I thawed out some bundles of what I thought was frozen brisket in the galley freezer. Well it wasn't brisket. Whatever it was, it was NOT SUPPOSED to be in the ship's freezer.
Whatever it was, it was in hibernation, not preservation. It came to life at about 450 degrees F....and man was it NOT HAPPY with ME. Before it could catch me and then banged an escape route out the side of the ship (into free space)...I ran the program backwards about 20 minutes too far. That's another whole episode by itself.
Suffice it to say, my grilling days are done for the time being. McCOy is asphyxiating laughing so hard. And some still unknown yeoman has some explaining to do regarding his creative, yet unsanctioned, use of ship's kitchen resources.

I would ask that you clarify something for those of us who disagree with you. Since it is now well established that SP is running an honest company which is producing results...what effect do you feel your constant baseless bashing will do for any potential investors coming by to check out Tivus? (I say "baseless" because as of right now, that is precisely what it is and has always been. )
Can we expect that unless you are 100% satisfied that everything is going to your liking that you will continue to assert that SP is a crook along with his crooked little company?

Interesting, but not what is prolly happening here, though. i just don'e see this carrying on for weeks on end the way it has as all of the AONs getting finally flushed out. Whatever is going on is a great object lesson in something. Just not sure what yet. Regardless, Tivus is growing. No denying that.

Had to laugh when someone here asked, "where is all the buying?" There has been nothing but buying going on here for several weeks now, People have quietly been loading and loading. The buzzkill here has been that every single time we see that the 2s are gone, lo, and behold---- 30 million more appear as if from an automated dispenser. It frustrates even the coldest Vulcan.
As for today... we must recall our recent lesson in Tivus-speak. Details expected by most are not immediately forthcoming. This is one of those niggly little things that SP needs to resolve and the sooner the better. How to balance the informational needs of the investors against the stealth required by the competitive marketplace. Not an easy walk to walk..especially as SP pointed out.. when some of your employees leave you to try and replicate your model to knock you out of the very marketplace you created.
Better perspective though is that SP can now tell other perspective clients that the waiting list for Tivus technology is growing so get in sooner or wait.
No matter how one slices this--even folks who would slice this into a pile of useless confetti, it is very positive news and it vindicates many here.
All of us now know all too well those who won't be happy unless they , themselves, are running Tivus..but they'll always be here and ..from time to time.. they do make good points. In the meantime I do enjoy being able to add to my holdings at lower prices but I know darned well my days (hours, even) nay be well numbered for getting away with that. Like many here I am in the "8 digit club" for holdings and I doubt I'll ever be able to exceed this..but I hope everyone who has been wanting to get more shares can do so sooner rather than later for with each passing week it becomes more obvious that the bargain prices have about run their course.
In the year 2211 Lnet does still exist, but they are in the business of running the equivalent of motor-home parks in the asteroid belt between Mars and Jupiter. Te do make some profit doing this. I only mention it for its trivia value.

Just wanted to say that I peronally feel excited for everyone who has found it within themselves to be patient throught the inevitable growing pains of a young, innovative company. Sure, we shall continue to be tried from time to time, but it seems clear to me now that Tivus is going somewhere.
It is attracting quality people. Trump says ,"Excellence attracts excellence." I think we'll continue to see that here as time moves on. I would like to see PRs that are more detailed and I woud like to see that when Tivus discloses something, that when a question is begged, it is addressed in the PR and that shareholders don't go through 2-3 days of speculation before clarity is brought.
Anyway, most of you now see why I was speaking in such positive tones after the CC. Tivus is real, it s good, it is growing and I feel very strongly that this is one of those situations where patience will pay off handsomely.
I hope everyone has a grand weekend and I look forward to being a part of the future of this company.
