Here's doc. #101 that the judge is referring to...states "with prejudice" not sure what ccgi doesn't understand.

Pursuant to Federal Rule of Civil Procedure 12(b)(1), Defendants, JNS Holding Corporation and JNS Power & Control Systems, Inc., by their attorneys undersigned attorneys, hereby move this Court to dismiss, with prejudice, the Amended Complaint (Dkt. 32) filed against them by Car Charging Group, Inc., 350 Holdings, LLC and 350 Green, LLC (“Plaintiffs”), because the Plaintiffs and the Defendants are not completely diverse, and this Court lacks subject-matter jurisdiction. In support of this Motion to Dismiss, Defendants contemporaneously file a Memorandum of Law.

Doesn't trade on a day to day basis. It's not liquid. If someone wants to sell 2M(20k) at todays price, they'll have to sell under .01. JNSH is at an average of .01 for the last 5 years. If it does go to .02, it's for a few days with I think very little money volume...same if it goes to .007. Maybe things will change when/if the lawsuit settles.
Also, I expect a pacer filing by CCGI before the end of January to delay...cause that's what they do.
Hoping JNSH has so much work this year, they raise the A/S and do a promo. In 2013, issuing 20m for less than .005 was retarded.

Getting paid from CCGI will be very easy. They will sell shares like they have been for months. Why do you think their A/S is over 5 times higher than O/S? This is getting very basic investing public info.

From my understanding the 4020 case is on the appeals court. Doc #34 in 13-3365, JNSH is trying to clarify what CCGI is trying to appeal.

7. On September 24, 2013, in a single order containing both captions, this Court
ruled on both JNS Power’s and CCGI’s respective motions, granting JNS Power’s motion, and
denying CCGI’s motion. The order was entered separately on both case dockets (JNS Power
Case at Dkt. 50; Car Charging Case at Dkt. 61).
8. On October 23, 2013, CCGI, 350 Holdings and 350 Green filed their notice of
appeal of this Court’s denial of their partial summary judgment in the Car Charging Case, i.e., in
case no. 13-cv-3124 (Car Charging Case, Dkt. 65).
9. As CCGI, 350 Holdings and 350 Green’s notice of appeal was filed only in the
Car Charging Case (13-cv-3124), and not in the JNS Power Case (13-cv-4020), only the record
and documents in the Car Charging Case (13-cv-3124) were transmitted to the Court of Appeals
(Car Charging Case at Dkt. 75, attached hereto as Exhibit 1); see also Seventh Circuit Court of
Appeals, case no. 13-3665 (“Appellate Case”) at Dkt. 14, which shows that three (3) volumes of
pleadings were sent to the Court of Appeals, consisting only of documents in the 13-cv-3124
case (a copy of the docket in the Appellate Case is attached hereto as Exhibit 2).
10. After considering various jurisdictional memoranda filed by the parties, the
Seventh Circuit Court of Appeals ruled on August 8, 2014 that this Court’s order denying the
Car Charging parties’ partial summary judgment motion in the 13-cv-3124 case was not
appealable. However, the Court of Appeals ruled the appeal would proceed in the JNS Power
Case (13-cv-4020) as to this Court’s granting of JNS Power’s partial motion for summary
judgment for specific performance. (Appellate Court, Dkt. 22, attached hereto as Exhibit 3).
11. Consistent with its ruling, the Court of Appeals re-captioned the case name in the
Court of Appeals to reflect the caption in the JNS Power Case: JNS Power & Control Systems,
Case: 1:13-cv-04020 Document #: 99 Filed: 09/26/14 Page 3 of 30 PageID #:1394

Inc. as plaintiff (appellee), and 350 Green, LLC as defendant (appellant). (see Exhibit 2,
Appellate Case Docket at Dkt. 23).
12. As none of the documents from the JNS Power Case (13-cv-4020) have been
transmitted to the Seventh Circuit Court of Appeals, the record on appeal is deficient, and it is
necessary to supplement the record on appeal with the appropriate pleadings, motions,
memoranda, exhibits and other related documents in the 13-cv-4020 case.
13. The undersigned attorney attempted to consult with Defendant 350 Green’s
attorney, but was unable to receive confirmation of agreement as counsel was out of the office in
observance of Rosh Hashanah. The undersigned will attempt to contact opposing counsel again
regarding their agreement to this motion, and will report to the court any agreement if obtained
prior to the hearing date of this motion.
WHEREFORE, JNS Power respectfully requests that this Court enter an order that the
record on appeal be supplemented with the necessary pleadings, motions and other pertinent
documents from the instant case (13-cv-4020), and that the Clerk of the United States District
Court for the Northern District of Illinois, Eastern Division, prepare the documents in the form
required for transmission to the Seventh Circuit.
