Jury Awards Rambus $306.5M in Damages for Infringing U.S. Sales
All Rambus Patent Claims in Trial Found Valid and Infringed
LOS ALTOS, Calif.--(BUSINESS WIRE)--April 24, 2006--Rambus Inc. (Nasdaq:RMBS - News) today announced that the jury in its month-long patent infringement trial against Hynix Semiconductor (000660.KS) has found that all ten Rambus patent claims at issue in that trial are valid and infringed. The jury also today awarded Rambus infringement damages in the amount of $306.5M, which represent compensation only for that portion of Hynix's SDRAM, DDR SDRAM and DDR2 memory products sold in the United States. The damage award covered Hynix sales between June 2000 and the end of 2005. This award does not yet include any pre-judgment interest, which is a typical element of damages that requires further consideration by the trial judge.

Rambus has also asked for permanent injunctive relief against Hynix to stop the manufacture, use, sale, or import of infringing Hynix memory products. Those Hynix counterclaims include challenges to the enforceability of Rambus patents and allegations that Rambus defamed DDR SDRAM or otherwise impeded market adoption of DDR SDRAM.

This case was originally filed by Hynix against Rambus in August 2000 seeking declaratory judgments that 11 patents are invalid and not infringed. Rambus countersued, and eventually the case was expanded to include Hynix's SDRAM, DDR and DDR2 memory products and 59 patent claims from 14 Rambus patents. In pre-trial proceedings, the trial judge granted summary judgment in favor of Rambus finding infringement as to 11 of the original 59 patent claims. The trial judge subsequently permitted ten patent claims to be presented to the jury at trial, including two that were the subject of the favorable summary judgment motion. The jury was asked to consider whether Hynix products infringed the remaining eight claims and to consider a variety of challenges by Hynix to the validity of all ten claims. The jury upheld Rambus' position on each of these issues. The case was tried in the San Jose division of the United States District Court for the Northern District of California, the Honorable Ronald Whyte presiding.
In addition to the still pending Hynix case, Rambus has other patent cases pending against Micron (NYSE: MU - News), Samsung (005930.SE) and Nanya (2408.TW), addressing similar patent claims against similar products, as well as other issues. Rambus also has a pending patent case against Micron, Samsung and Nanya addressing, among other things, more advanced patented technologies as used in more advanced memory products such as DDR2, GDDR2 and GDDR3. SAN JOSE, Calif. - Dialing into the fast-growing market for mobile games, a San Francisco-based startup is poised to unveil a new service on Monday that it hopes will make television viewers as hooked to their cell phones as they are to remote controls.

AirPlay Network Inc. said it will introduce a lineup of cell phone games tied to live television broadcasts. While watching TV, subscribers could use their cell phones to compete against others in "real time" by predicting plays in sports, choosing winners on reality TV shows or picking answers on game shows.
The first product, "AirPlay Sports," is due for release in the fall to coincide with the start of the professional football season. An NFL-related AirPlay game, for instance, would ask cell phone quarterbacks to predict the offense's next moves — a pass or a run — as the real game unfolds live on television.
Other games tied to reality TV and game shows will be launched next, according to the company.
AirPlay subscribers would have to use an Internet-connected cell phone to play. They would download games to their handsets directly through AirPlay's Web site or through a partnering wireless carrier. The subscription fee has not been disclosed yet.
"We're creating a multiplayer experience and a social network synched with television," said AirPlay CEO Morgan Guenther, a former president at TiVo Inc. The idea, he said, is to transform TV from a passive pastime to an engaging, competitive experience.
Guenther contends the concept differs from earlier failed attempts to make TV interactive because AirPlay uses the ever-ready cell phone as the interface instead of an Internet-connected television.
"Chances are, the cell phone is right next to them already," he said.
It also factors in the social aspects of gaming that have drawn millions of players to compete for rankings on community-like scoreboards, according to Guenther. Other game companies, such as Digital Chocolate Inc., have also introduced multiplayer-type games for the cell phone.
AirPlay is backed by $4 million from Redpoint Ventures and cell phone technology provider Qualcomm Inc.

Chemicals Maker DuPont to Slash 1,500 Jobs, Raises 2006 Earnings Outlook
DOVER, Del. (AP) -- Chemicals maker DuPont Co. said Wednesday it plans to cut 1,500 jobs and close four facilities in Europe in a restructuring of its performance coatings business and raised its overall earnings outlook.

DuPont officials said the restructuring, which will take about 18 months to complete, will reduce annual costs by about $165 million. The Wilmington-based company anticipates taking a pretax charge up to $165 million in the first quarter, with additional costs of up to $55 million over the next year.
In a separate announcement, the company raised its first-quarter profit guidance to 80 cents per share, up from a January estimate of 70 cents per share. For 2006, DuPont revised its earnings estimate to $2.70 a share, up 10 cents from its earlier projection.
The revised quarterly and full-year guidance excludes the $165 million pretax charge related to the restructuring plan, officials said.
Analysts polled by Thomson Financial had forecast per-share profit, excluding special items, of 71 cents in the first quarter and $2.64 for the year.
Dupont chairman and chief executive Charles Holliday Jr. said the revised guidance estimates are not related to the restructuring plan, but are based instead on improved operating performance, fixed cost controls, and the earlier-than-expected restart of production at a hurricane-damaged titanium dioxide plant in DeLisle, Miss.
Holliday said that with the restructuring of its underperforming performance coatings business, DuPont is sending a message to industry analysts who have said the company needs to execute its plans to improve productivity and competitiveness.
"I agree," he said. "Today's announcement reinforces that."
In morning trading on the New York Stock Exchange, DuPont shares rose 89 cents, or 2.1 percent, to $42.81. They have traded in a 52-week range of $37.60 to $54.23.
DuPont officials said restructuring will include the closings of two manufacturing plants in Spain, one plant in the Netherlands, and a laboratory in Germany. In addition to those four operating facilities, the company also will close one warehouse in Germany and another in the United States, and consolidate two other U.S. warehouses in a new location.
DuPont announced last month that it was closing an automotive coatings lab in Troy, Mich., and eliminating 200 positions there.
Holliday said the "great majority" of the 1,500 job cuts announced Wednesday will be in Europe, although he did not have specific numbers.
Officials said DuPont will try to redeploy as many of the affected employees as possible elsewhere within the company.
In addition to the job cuts, DuPont said it plans to consolidate manufacturing and technical assets and tailor market strategies to key customers and segments.
Holliday said that while performance coatings is a core business for DuPont, market conditions over the past three years have resulted in the unit performing below the company's goal for each business unit to show at least a 12 percent return on net assets.
The restructuring is expected to result in savings of about $70 million this year, which will be largely offset by accelerated depreciation. Another $100 million in cost savings is expected in 2007.
While DuPont has focused recently on growth industries such as bio-based materials, chief financial officer Gary Pfeiffer downplayed suggestions that the company should consider divesting itself of performance coatings. Having a balanced portfolio of businesses with cash generation capacity and businesses with growth capacity is economically advantageous, he said.
