The claim for relief is for Libel and Business Defamation, primarily focusing on posts that refer to "mob," "scammy," or "6'6" housemate."
ATG, and Fred individually, are seeking actual damages, exemplary and punitive damages, and attorney's fees. The damage that they indicate in the pleadings is damage to personal reputation and damage to business reputation. They also ask for a permanent injunction against these posters making any future written negative or oral statements in any public forum regarding Ritterieser, ATG, its subsidiaries, affiliates, officers, directors, shareholders, employees, products, services or investment performance.
They also ask for publication of an immediate retraction and apology.

My first paragraph was not a joke. Paragraph 16 of the complaint states:
"Furthermore, Cummins has posted to the Message Board, on numerous occasions, that Ashton and Rittereiser have 'lied' to Ashton shareholders, are 'scammy,' that Ashton 'chose to be IPO'd by the mob' and 'let the mob manipulate their stock.' She also wrote that Rittereiser 'has been involved with SEC fraud and boiler room operations' and 'knowingly got in bed with' organized crime."
Paragraph 30 (section on Claim for Relief) states: "As detailed above, Defendants Cummins and John Does #1 through #5, have made statements of fact that Rittereiser has committed fraud upon the shareholders of Ashton, is involved with, connected with, or controlled by organized crime, is a liar, and has personally profited from illegal activities."
Paragraph 31 states: "As detailed above, Defendants Cummins and John Does #1 through #5 have published written statements of fact that Ashton has committed fraud upon its shareholders, is involved in or controlled by organized crime, and that Ashton's product, eVWAP, is part of a Mafia plan to provide organized crime with access to global financial structures."
Paragraph 32 states: "The above-detailed written statements of fact, publicly posted onthe Message Board, were false at the time at which they were made, and were made by Cummins and John Does #1-#5 maliciously, intentionally, and with knowledge of the falsity of those statements."
I think my characterization -- that this case is a claim of Libel and Business Defamation, focusing on "mob" posts and "scammy" posts -- is pretty much on point.
The fact that they asked for 50K or less in damages in no way undercuts the statement that I made -- which is that they claimed damages. Check the Wherefore clause between paragraphs 39 and 40. I was quoting it in my previous post on the quetion of damages.
Yes, ATG wants you to stop posting. I don't know whether they can win that or not, and I'm not expressing an opinion about who will win this suit. I'm just telling people what the claims are. I don't particularly see any inaccuracies or errors in the filing, but if you do, feel free to post them.

The Ashton Technology Group, Inc. Reports First Quarter Financial Results
PHILADELPHIA--(BUSINESS WIRE)--July 27, 2001--The Ashton Technology Group, Inc. (NASDAQ:ASTN - news) today announced that its net loss for the first fiscal quarter ended June 30, 2001 totaled $4 million compared to a net loss of $3.1 million in the same quarter of the prior fiscal year.
The net loss applicable to common stock for the quarter ended June 30, 2001 totaled $.14 per share, compared to a net loss of $.12 per share during the three months ended June 30, 2000.
Revenues increased approximately 350% to $205,738 during the three months ended June 30, 2001 from $46,117 during the same period last year. Ashton's eVWAP(TM) system, a pre-open intelligent matching system offered through the Philadelphia Stock Exchange, matched (or crossed) a total of 23.6 million shares during the quarter ended June 30, 2001 compared to 3.1 million during the same period of 2000.
Since April of 2000, Ashton has expanded the number of eVWAP eligible securities from 50 to include the listed component of the S&P 500, to total approximately 460 securities. In addition, during July 2001, Ashton introduced a ``Guaranteed eVWAP Execution Program'' in the S&P 500 listed stocks. The eVWAP system now has an average of 100 million shares available on a daily basis for institutional clients.
Additional broker-dealers are expected to be added by the end of September that would further increase the potential liquidity available to institutional clients.
Total costs and expenses were $4.2 million during the quarter ended June 30, 2001 compared to $3.1 million during the quarter ended June 30, 2000. Salaries and employee benefits increased 27% to $1.6 million from $1.2 million due to a larger number of employees. Professional fees increased 69% to $793,265 from $468,925 primarily as a result of an increase in outsourced labor working on the development of our intelligent matching systems.
Brokerage, clearing and exchange fees increased to $533,503 from $160,145 as a result of the costs associated with increased trades executed by Croix and ATG Trading, our subsidiaries. ATG Trading's activity has decreased significantly since May 2001 as a result of new liquidity providers participating in eVWAP. Selling, general and administrative expenses decreased 3% to $827,315 in the first quarter this year from $850,813 in the first quarter last year.
During the year ended March 31, 2001, Ashton's subsidiary, Electronic Market Center, Inc. (eMC) began the orderly winding down of its operations as a result of market conditions and a lack of financing available to complete its development. As a result, eMC's results of operations have been reclassified as discontinued operations. eMC incurred an operating loss of $889 in the three months ended June 30, 2001 compared to $286,701 for the same period of 2000.
Ashton's President, Arthur J. Bacci, said, ``This quarter is the first indication of the progress we are making in introducing our eVWAP system into the market. Given our July activity and new customer responses, we anticipate meaningful growth in revenues during the second quarter. We also continue to take steps to reduce our operating expenses. Thanks for that very interesting article. I know of another case where a poster stated that the SEC was suing a company which was false. That poster is currently being sued by said company. It will be interesting to see how that turns out.
IMO there has to be some consequence for this kind of maliciousness.
