StewbieJay, I am referring to the current court case docs. Its all in there. Everything I have posted is directly from them. But as Phil has found out there are a lot of pages and some are copies that are hard to read. If he copied everything he will figure it out.
Phil, the story is in the docs but I understand its a lot to wade through. After they got the copy from Simpson after the court fight they found out he gave them the original 2.0 they got from Iterated back in 2000, not the copy they had already spent hundreds of thousands of dollars updating. So they went to MediaBin who had a copy of that updated version because DFMI had been paying MediaBin people to assist and MediaBin had kept copies. MediaBin (was Iterated) had them sign a new contract in 2003 and pay them to get that updated copy. Sloan was long gone and another officer signed the contract, don't remember the name but a copy of that contract is in the filings.
Sloan never said that ridiculous story, it was Simpson. He had to come up with some BS story since his lie about not turning over the code to DFMI was proved to be false. Simpson never figured out that once he starts lying he has to keep making up bigger and bigger whoppers to cover himself. Only works so long, then you get caught.
Phil, I think the Jeff Phillips affidavit has that story in it and TMM included it in the original complaint but dropped it in their amended complaint. DFMI got one copy of the code from Simpson in the court battle result and another more updated copy directly from MediaBin.
General, they haven't advertised it but TMM has been busy throwing lawsuits against anyone and everyone the past year but all little guys up till this point. In this case they didn't do any homework and lied about talking to Dimension first. Major screwup. They had no idea how large and well financed Dimension really was. Looks like a fatal mistake.
Since I read all the filings I can tell you that Phil has already shared the highlights for TMM. Their new lawyer's wife had a baby, congrats to them and their other lawyer took a hard earned vacation, enabling TMM to get yet another delay and I heard they have asked for more delays to attend some conferences. Sounds like they are not in a hurry to get into court and get their butt kicked.
Phil, the documents showing chain of ownership of the 2.0 codec are in the defendant's exhibits filing for the current case.
StewJay, as I said the copies of all those court actions are in the current court case docs, no need to shop around its all in one place. Some of the words will be way to big for you to understand but you should give it a try.
StewJay, Iterated wrote a contract signed by Sloan that took the codec away from DFI and put it in DFMI. TS never legally gave the code to TMM, he illegally sold something he didn't own. Panik got it from DFMI through a different court action and put it in Dimension. Its all in the current court docs, do some homework! As for how you know TS is lying, you can tell because his lips are moving!
No, they don't work for TMM. Barnsley cashed out around 20 years ago and last I heard was teaching in Australia. Sloan also cashed out a long time ago and is just an advisory board member who is probably rethinking that decision right now. Sloan did sign the contract with DFMI giving them the fractal video codec licensing rights. Then they have another doc that shows execs in the successor companies giving DFMI additional rights. And there's more court docs showing the transfer to Dimension. Nothing helping TMM since they got booted by Iterated in 1996, other than the bogus Simpson/DFI doc that won't hold up in any court.
Phil, the records were on the third floor as I recall. Just tell them you want to see the filings for a pending case. No charge unless you want to print some pages. I'd skip the first round of complaint and answers since its about the same as the second round of filings. Main difference is TMM dropped the Jeff Phillips stealing the code issue.
The Iterated lawyer letters are in the defendants answers exhibits. Its likely this whole thing will be thrown out based on time limits but I doubt this will be the end of the matter. If you have 30-45 minutes you can get through the whole story and all the docs that explain it.
Since I've already been to the court and read the filings I can save you some time. That silly story is in the first complaint. TMM dropped it from the amended complaint, apparently they found out it was just another of the endless Simpson lies. The rest of the complaint really didn't appear to be any more truthful but that will be clear once everyone reads it.
TMM bought the word Trudef from Simpson several times so yes they probably own it by now. Congrats!

Phil, once you read the docs you will understand who has the stolen copy of the code. Most likely whatever Tmm is doing will end up belonging to Dimension, but as you say lets leave it to the judge. Good luck in your poker tourneys.
Just guessing but they would probably have the kind of update that announces a deal, not one that says, Wow, our software works on a computer!
StewJayTommie, you're talking about a completely different patent and still haven't pointed to any assignment or valid contract that gives TMM any rights whatsoever to it.
That's right StewJay, 1987 is certainly not on or before 6/97! Or at least not on your planet.
Don't know about NY but in Nevada the judge is not going to read 500 pages before granting an auto delay.
Phil, the whole enchilada is in the filings. You will understand once you read them. You should also read the TMM lawsuit against Simpson a few months ago. That's the one they should have stuck with. Now they've got their tit stuck in the wringer and can't figure how to get it out.

Stew Jay, go read the court filings. The BK was covered in the 1996 deal, it's no help. The word Toast comes to mind.
TMM owns fractal compression? ISI cancelled all TMMs rights due to non-payments. TMM tried to buy stolen property from Simpson-DFI, but that gives them no real ownership. Other idiots try to claim 1987 pre-patent rights, which I assume they dreamed up in a drug related stupor. It's a shell, period.

Phil, I'm not a lawyer either but deal with a lot of contracts. These are pretty straightforward. The first part of the 1996 contract clearly voids whatever came before it. Next read the letters between the ISI lawyers and the TMM guys. TMM apparently couldn't pay and the rights they got in the 1996 contract went kaput. Lots of docs on the ownership chain of the 2.0 stuff that came later. Signed docs from Simpson and ISI and letters from Haskins saying ISI took back the 2.0 and gave it to DFMI. I'm confused on where there's a case, other than against Simpson for selling something he clearly didn't own. In his affidavit he claims he got it from DFMI in their lawsuit but the lawsuit docs from that suit say the opposite and there's docs from a court appointed CPA that say he embezzled hundreds of thousands of dollars and a forensic report that docs were forged to his benefit. Even an affidavit from Fernandez and TMM that Simpson forged Fernandez's signature on some other docs.
Like I said, read them and see if you see anything different. Jay, share some of whatever you are smoking, you obviously haven't read anything. I'm sure Phil will confirm that too.
Jay I'm not 4retire and live in Vegas, so it's not a big deal to go to the courthouse. You clearly haven't read the motion for today, it is only about TMM getting a one week delay. It says one attorney is out of the country and the others wife just a baby. The third one is also from Vegas and will be doing the hearing today. Too busy today to attend. I haven't commented on what the ISI contracts said, hopefully Phil will read them and give his better accepted opinion.
Hearing is at 9am. It's just about TMM asking for a one week delay for the main hearing. I was in Vegas a few days ago and went through most of the filings. Mostly contracts and copies of other lawsuits. The old contracts between TMM and ISI are interesting reading.
